Although draft article 44 of the draft articles on responsibility of international organizations is, as already mentioned, worded in the same way as the equivalent article on responsibility of States for internationally wrongful acts, its wording and the corresponding commentary do not leave open the possibility of establishing exceptions to the nationality rule contained therein.

It would be useful to consider the issue in the context of the relevant provisions of chapter II of the draft articles on responsibility of States for internationally wrongful acts, which described the attribution of conduct to a State and also dealt with de facto links between individuals and States.
