Subject to the provisions of article 148 set forth below, article 139 of the amended Act stipulates that: " The duration of custody is nine years in the case of a boy and 12 years in the case of a girl, unless the judge decides otherwise in the interests of the child. "
ونصت المادة 139 من القانون المعدل على أن " مدة الحضانة تسع سنوات للذكر واثنتي عشرة للأنثى ما لم يقدر القاضي خلافه لمصلحة المحضون " مع مراعاة أحكام المادة 148 التالية الذكر.

This has been outlined above (see response at 2) and it is to the effect that section 11 A of the amended Act specifically provides that -
وقد أجمل هذا أعلاه (انظر الرد في الفقرة 2) وفي هذا الخصوص تنص المادة 11 ألف من القانون المعدل على ما يلي -

(a) The draft bill establishes an equality representative in enterprises which employ at least 15 workers, whether of the same sex or of different sexes, using the legal framework of the amended Act of 18 May 1979 constituting a reform of staff committees.
- يهدف مشروع القانون إلى تعيين مندوب معني/مندوبة معنية بالمساواة في المؤسسات التي يعمل بها على اﻷقل ١٥ عاملا/عاملة من جنس واحد أو من الجنسين، باستخدام اﻹطار القانوني للقانون المعدل في ١٨ أيار/مايو ١٩٧٩ الذي أدخل إصلاحات على لجان الموظفين.

The CTC would however, be grateful to receive a copy of the amended Act 9613/98 and Act 7.170/83 which according to the third report (at page 3) criminalize the financing of terrorism.
بيد أن لجنة مكافحة الإرهاب ستكون ممتنة لو تلقت نسخة من القانون المعدل 9613/98 والقانون 7.170/83، اللذين يجرمان تمويل الإرهاب، وفقا لما ورد في التقرير الثالث (في الصفحة 3).

Section 11A of the amended Act provides for the freezing of funds of persons who commit or attempt to commit, or who facilitate or participate in or finance acts of terrorism - or of any person who is controlled directly or indirectly by, or who acts on behalf or at the direction of the first-mentioned person.
وتنص المادة 11 ألف من القانون المعدل على تجميد أموال الأشخاص الذين يرتكبون أو يحاولون ارتكاب أعمال إرهابية أو يعملون على تسهيل القيام بها أو المشاركة فيها - أو أي شخص يخضع بصورة مباشرة أو غير مباشرة لتوجيهات أي من الأشخاص السابق ذكرهم، أو يرتكب تلك الأعمال نيابة عنهم.

The financial intelligence unit of the Luxembourg Public Prosecutor, for its part, carries out the responsibilities entrusted to it under article 40 of the amended Act of 5 April 1993 concerning the financial sector (cf. 1.1 above) and by article 26-2 of the Code of Criminal Procedure (cf. 7.3 below). 4.6.
وتمارس خلية المخابرات المالية التابعة لمكتب المدعي العام للكسمبرغ من جهتها الاختصاصات المسندة إليها بموجب المادة 40 من القانون المعدل المؤرخ 5 نيسان/أبريل 1993، والمتعلق بالقطاع المالي (انظر الفقرة الفرعية 1-1 أعلاه)، وكذلك بموجب المادة 26-2 من قانون التحقيق الجنائي (انظر الفقرة الفرعية 7-3 أدناه).

In accordance with article 5 of the amended Act of 15 March 1983 on arms and ammunition, the import, manufacture, transformation, repair, acquisition, purchase, possession, stockpiling, transport, transfer, sale, export and trade of arms and ammunition are subject to authorization by the Minister of Justice.
وفقا للمادة 5 من القانون المعدل في 15 آذار/مارس 1983 بشأن الأسلحة والذخائر، يخضع استيراد الأسلحة والذخائر وتصنيعها وتحويلها وإصلاحها واقتناؤها وشراؤها وحيازتها وتخزينها ونقلها ونقل ملكيتها وبيعها وتصديرها والاتجار بها لترخيص من وزير العدل.

In accordance with article 5 of the amended Act of 15 March 1983 on arms and ammunition, the import, manufacture, transformation, repair, acquisition, purchase, possession, stockpiling, transport, transfer, sale, export and trade of arms and ammunition are subject to authorization of the Minister of Justice.
بموجب المادة 5 من القانون المعدل في 15 آذار/مارس 1983 بشأن الأسلحة والذخائر يخضع استيراد الأسلحة والذخائر وتصنيعها وتجهيزها وإصلاحها وامتلاكها وشراؤها وحيازتها وتخزينها ونقلها ونقل ملكيتها وبيعها وتصديرها والاتجار فيها لترخيص من وزير العدل.

325. Article 1 of the amended Act above falls into line with article 40. Equally, Article 67 of the Egyptian Constitution states that a " defendant is innocent until proved guilty in legal trial, in which he is granted the right to defend himself.
325- أما بالنسبة للمادة 40، فإن المادة 1 من القانون المعدل المشار إليها أعلاه تتفق معها، وكذلك فإن المادة 67 من الدستور المصري، تنص على أن المتهم بريء حتى تثبت إدانته في محاكمة قانونية تكفل له فيها ضمانات الدفاع عن نفسه.

(a) Arms embargo: In accordance with article 5 of the amended Act of 15 March 1983 on arms and ammunition, the import, manufacture, transformation, repair, acquisition, purchase, possession, stockpiling, transport, transfer, sale, export and trade of arms and ammunition are subject to authorization by the Minister of Justice.
(أ) حظر الأسلحة: بموجب المادة 5 من القانون المعدل في 15 آذار/ مارس 1983 بشأن الأسلحة والذخائر، يخضع استيراد الأسلحة والذخائر وتصنيعها وتجهيزها وإصلاحها وامتلاكها وشراؤها وحيازتها وتخزينها ونقلها ونقل ملكيتها وبيعها وتصديرها والاتجار فيها لترخيص من وزير العدل.

326. As for having " the matter determined without delay by a competent, independent and impartial authority or judicial body in a fair hearing according to law " , articles 121 and 122 of the amended Act provides for specialized courts to consider cases brought against children and special prosecution services to investigate offences committed by them before referral to court or the dropping of charges.
326- أما بالنسبة " لقيام سلطة أو هيئة قضائية مختصة ومستقلة ونزيهة بالفصل في دعواه دون تأخير في محاكمة عادلة وفقاً للقانون، إلخ " فإن نص المادتين 121 و122 من القانون المعدل يتضمن محاكم متخصصة لنظر القضايا التي يتهم فيها الأطفال وكذا نيابات متخصصة مناط بها التحقيق في الجرائم التي يرتكبها الأطفال يعقبها الإحالة إلى محكمة الطفل أو حفظ القضية.
