The Committee discussed the case at its forty-seventh session and decided to remind the State party of its obligation to prosecute and try Mr. Habré, or alternatively to extradite him to Belgium, as this country had made such an request, or to another country to be tried there, and to avoid having Mr. Habré leave Senegal except if his departure is in conformity with the Convention's provisions.

The Convention provides that a State on whose territory a person suspected of a terrorist bombing crime is found must either prosecute the suspect or extradite him to another State willing to prosecute (art. 8 (1)).
