ويتوجب على هذه المؤسسات أو الأشخاص أن ينظموا شهادة بالولادة ويرسلونها إلى أمين السجل المدني لتدوينها وفق الأحكام السابقة بعد تسمية المولود ووالديه بأسماء منتحلة يختارها أمين السجل المدني.

In addition, the Civil Registrar registers, gives a name to, and determines the identity of foundlings in accordance with the provisions of the Civil Status Code, to which reference was made in paragraph 70 of Syria's initial report.
هذا إضافةً إلى أن تسجيل الأطفال اللقطاء وتسميتهم وتحديد هويتهم يتم من قبل أمين السجل المدني وفقاً لأحكام المادة 34 من قانون الأحوال المدنية والتي جاء ذكرها في الفقرة 70 من التقرير الأولي.

The institution or individual concerned shall prepare a birth certificate and forward it to the Civil Registrar for registration in accordance with the preceding provisions. the Civil Registrar shall assign a name to the child and/or its parents, such name or names to be selected by the Civil Registrar himself.

Article 41 entrusts the Civil Registrar with the task of registering deaths, one after the other, in the special register for that purpose in accordance with the information shown on the death certificate and stipulated in article 35.

3 - تطبق الطريقة نفسها في تسجيل الأحكام الصادرة بتثبيت الزواج والطلاق والنسب ووفاة المفقود، ويقوم أمين السجل المدني بتدوين ذلك في السجلات المخصوصة دون حاجة إلى أي إجراء آخر.

Article 37 requires that directors of institutions such as hospitals, prisons, and quarantine stations, etc., have an obligation to notify such incidents to the Civil Registrar within the specified time. Such cases do not require authentication by the local mayor, but should be registered in a special register to be kept with the institution.
كما أوجبت المادة 37 من نفس القانون أن يقوم مدراء المؤسسات ذات العلاقة مثل المستشفيات والسجون والمحاجر وغيرها بإرسال شهادات الولادة الواقعة في مؤسساتهم إلى أمين السجل المدني دون الحاجة إلى تصديق من المختار، وعليهم أن يمسكوا سجلات خاصة لتدوين هذه الوقائع.

328. Under article 37 of the same Act, directors of institutions such as hospitals, prisons and quarantine stations, etc., have an obligation to transmit to the Civil Registrar the birth certificates of children born in their institutions, although these do not need to be authenticated by the local mayor.
328- كما أوجبت المادة 37 من نفس القانون أن يقوم مدراء المؤسسات ذات العلاقة مثل المستشفيات والسجون والمحاجر وغيرها بإرسال شهادات الولادة الواقعة في مؤسساتهم إلى أمين السجل المدني دون الحاجة إلى تصديق من المختار، وعليهم أن يمسكوا سجلات خاصة لتدوين هذه الوقائع.

68. ٨٦- كما نصت المادة ٧٣ من نفس القانون على أنه يجب على مديري المؤسسات كالمستشفيات والسجون والمحاجر وغيرها أن يرسلوا إلى أمين السجل المدني شهادات الولادة الحادثة في مؤسساتهم دون حاجة إلى تصديقها من المختار وعليهم أن يمسكوا سجلات خاصة لتدوين هذه الوقائع.

33. Mr. NSEIR (Syrian Arab Republic) said that every child had the right to a name, which was given by the father, or by the mother if the father was unknown, or else by the Civil Registrar if both parents were unknown (see para. 65 of the report).
٣٣- السيد نصير )الجمهورية العربية السورية(: قال إن لكل طفل الحق في اسم يعطيه إياه اﻷب، أو اﻷم إذا لم يكن اﻷب معروفاً، أو أمين السجل المدني إذا كان اﻷبوان كلاهما مجهولين )انظر الفقرة ٥٦ من التقرير(.

Article 26 thereof stipulates that the father must present the birth certificate, authenticated by the local mayor, within the prescribed time limit. In the father's absence, this obligation devolves on the local mayor or the male relatives of the newborn child living in the house in which the birth took place. The physician or midwife is required to notify the Civil Registrar of the birth.
فأوجبت المادة 26 منه على الوالد تقديم شهادة الولادة مصدقة من المختار ضمن المهلة، وإذا كان الوالد غير موجود يعود هذا الواجب على المختار أو على أقرباء المولود الذكور المقيمين في نفس الدار التي حصلت فيها الولادة، والطبيب والقابلة ملزمان بإخبار أمين السجل المدني بالولادة، وإذا تمت الولادة خارج منزل الزوجية، فالشخص الذي حصلت الولادة في منزله مكلف بتقديم شهادة الولادة.

the Civil Registrar must give the child a full name, preferably a common name or derived from any particular characteristic or from the place where the child has been found, but always in order to avoid misleading designations or designations that may recall the child's abandoned condition (Article 108, paragraph 1).
149- ويجب على أمين السجل المدني أن يمنح الطفل اسماً كاملاً من المفضل أن يكون اسماً عاماً أو اسماً منبثقاً عن أي ميزة خاصة أو عن مكان العثور على الطفل على نحو يكفل على الدوام تجنب التسميات المضللة أو التسميات التي قد تذكر بظروف هجر الطفل (الفقرة 1 من المادة 108).

121. the Civil Registrar names foundlings (Personal Status Code, arts. 34 - 36). The Personal Status Code sets out the method of registration and the obligations required of the father, doctor, midwife and hospital directors. A fine or a penalty of imprisonment for between 10 days and 1 month will be imposed if the time limits for registration are exceeded (Personal Status Code, art. 22 et seq.).
121- ويقوم أمين السجل المدني بتسمية اللقطاء (المواد 34-36 من قانون الأحوال المدنية)، ويبيّن قانون الأحوال المدنية طريقة التسجيل والالتزامات المفروضة على كل من الوالد والطبيب والقابلة ومديري المستشفيات تحت طائلة المساءلة القانونية بفرض غرامة مالية أو عقوبة الحبس لمدة عشرة أيام إلى شهر في حالة تجاوز المدد والمواعيد المحددة للتسجيل (المادة 22 وما يليها من قانون الأحوال المدنية).
