57. The Special Rapporteur is of the opinion that national institutions with a broad and clear mandate are able to work independently and more effectively, leading to a higher degree of legitimacy among their constituencies.

The responses received to the questionnaire sent by the Special Rapporteur indicate that national institutions face considerable challenges and constraints when discharging their functions to promote and protect human rights, including when interacting with human rights defenders, which could seriously undermine their independence, efficiency and legitimacy.

The Government and the Kimberley Process Certification Scheme review mission, which visited Liberia from 18 to 28 March, agreed that national institutions continued to face technical and financial challenges in managing the alluvial diamond sector and in abiding by the principles and recommendations of the Scheme.

Namibia recognized that primary responsibility for implementing gender policies rested with national governments but believed that national institutions, particularly in the least developed countries (LDCs) and the developing countries, required support and assistance from the developed partners, especially in capacity building for implementing national gender policies.

99. Mr. Gooda highlighted that NHRIs are an exceptional model for advancing the recognition and protection of the rights of indigenous peoples.
