By 47 votes to 27, with 25 abstentions, the Assembly decided that the rule did not apply to elections to the Court and it proceeded to elect the requisite number of candidates by a series of unrestricted ballots.

One delegation noted that this article did not sufficiently take into account the principle of aut dedere aut judicare, in particular in respect of the establishment of jurisdiction.

(9) Paragraph 2 explains that the present article does not require the act to be internationally wrongful for the international organization concerned.
