يضاف إلى هذا أن الدعوى التي رفعتها الطفلتان ضد مقدمة البلاغ بموجب المادة ٦٨ من الدستور كانت تحت ضغط من السيد أوسبينا ساردي.

٢-٥ وفي هذه اﻷثناء كان السيد أوسبينا ساردي قد بدأ من جانبه دعوى الطلاق في بوغوتا وطلب فيها تعليق السلطة اﻷبوية لمقدمة البلاغ كما طلب اصدار أمر يمنع الطفلتين من مغادرة كولومبيا.

2.1 Mrs. Fei married Jaime Ospina Sardi in 1976; in 1977, rifts between the spouses began to emerge, and in 1981 Mrs. Fei left the home; the two children born from the marriage remained with the husband.
الوقائع كما قدمتها صاحبة البلاغ: ٢-١ تزوجت السيدة فاي من خايمي أوسبينا ساردي عام ٦٧٩١؛ وفي عام ٧٧٩١ بدأت تظهر خلافات بين الزوجين، وفي عام ١٨٩١ تركت السيدة فاي المنزل؛ وبقيت الطفلتان المولودتان من هذا الزواج مع الزوج.

2.10 In 1992 and 1993, the Colombian courts took further action in respect of Mr. Ospina Sardi's request for a revision of parental custody and visiting rights, as well as in respect of complaints filed on behalf of the author in the Supreme Court of Colombia.
٢-٠١ وفي عامي ٢٩٩١ و٣٩٩١ واصلت محاكم كولومبيا اتخاذ اجراءات بشأن طلب السيد أوسبينا ساردي إعادة النظر في حضانة الطفلتين وفي حقوق الزيارة، الى جانب النظر في الشكاوى المقدمة من صاحبة البلاغ الى المحكمة العليا في كولومبيا.

4.3 With regard to the author's attitude between 13 March 1989 and 21 June 1991, the State party appears to endorse the contention of Mr. Ospina Sardi that, during this period, the author did not visit her children in Colombia and only maintained telephone or postal contacts with them.
٤-٣ وفيما يتعلق بموقف صاحبة البلاغ بين ٣١ آذار/مارس ٩٨٩١ و١٢ حزيران/يونيه ١٩٩١ يبدو أن الدولة الطرف تؤيد أقوال السيد أوسبينا ساردي بأن صاحبة البلاغ لم تزر الطفلتين خلال هذه الفترة في كولومبيا فكان اتصالها معهما هاتفيا أو بريديا.

الوقائع كما أوردتها مقدمة البلاغ: ٢-١ تزوجت السيدة فاي من خايمي أوسبينا ساردي عام ٦٧٩١؛ وفي عام ٧٧٩١ بدأت تظهر خلافات بين الزوجيـن، وفي عام ١٨٩١ تركت السيدة فاي المنزل؛ وبقيت الطفلتان المولودتان من هذا الزواج مع الزوج.

On 21 June 1991, Mr. Ospina Sardi filed a request for the revision of the divorce judgement and of the visiting rights granted to the author, on the ground that circumstances had changed and that visiting rights as generous as those agreed upon in 1985 were no longer justifiable in the circumstances; the author contends that she was only informed of those proceedings in early 1992.
وفي ١٢ حزيران/يونيه ٩٨٩١ قدم السيد أوسبينا ساردي طلبا لاعادة النظر في حكم الطلاق وفي حقوق الزيارة المقررة لمقدمة البلاغ على اساس أن الظروف تغيرت وأن حقوق الزيارة الواسعة التي اتفق عليها عام ٥٨٩١ لم يعد هناك ما يبررها في الظروف الجديدة؛ وتدعي مقدمة البلاغ أنها لم تبلغ بهذه الدعوى إلا في أوائل ٢٩٩١.

2.10 In 1992 and 1993, the Colombian courts took further action in respect of Mr. Ospina Sardi's request for a revision of parental custody and visiting rights, as well as in respect of complaints filed on behalf of the author in the Supreme Court of Colombia.
٢-٠١ وفي عامي ٢٩٩١ و٣٩٩١ واصلت محاكم كولومبيا اتخاذ إجراءات بشأن طلب السيد أوسبينا ساردي إعادة النظر في حضانة الطفلتين وفي حقوق الزيارة، إلى جانب النظر في الشكاوى المقدمة من مقدمة البلاغ إلى المحكمة العليا في كولومبيا.
