Viet Nam shall refuse extradition if it has reasonable grounds to believe that the person sought is being prosecuted or punished on account of his or her race, religion, sex, nationality, social status or political opinions.
وسوف ترفض فييت نام التسليم إذا كانت لديها أسباب معقولة للاعتقاد بأنَّ الشخص المطلوب يلاحق أو يعاقب بسبب أصله العرقي أو ديانته أو جنسه أو جنسيته أو وضعه الاجتماعي أو آرائه السياسية.

Similarly, a request must be refused if it was made to prosecute, punish or otherwise prejudice a person on account of his or her race, gender, religion, nationality or political opinions.
وبالمثل، يجب رفض الطلب إذا كان قد صدر بهدف ملاحقة شخص أو معاقبته أو المساس به خلاف ذلك بسبب عرقه أو جنسه أو دينه أو جنسيته أو آرائه السياسية.

5. The transit of the person concerned shall not be effected through a territory where there are grounds for believing that his life or liberty may be threatened by reason of his race, religion, nationality or political opinions.

134. It was expressly provided that nothing in the Convention should be interpreted as imposing an obligation upon a party to extradite a person who might then be prosecuted or punished solely on the grounds of race, religion, nationality or political opinion.

7. Extradition shall not be granted if the requested State Party has substantial grounds for believing that a request for extradition has been made for the purpose of prosecuting or punishing a person on account of his [or her] race, religion, [gender], nationality or political opinion, or that a person’s position may be prejudiced for any of these reasons.
٧ - لا يُوافق على التسليم اذا كانت لدى الدولة الطرف متلقية الطلب أسباب جوهرية تدعو الى الاعتقاد بأن طلب التسليم قُدم بغرض ملاحقة شخص أو معاقبته بسبب عرقه أو دينه ]أو نوع جنسه[ أو جنسيته أو آرائه السياسية أو بأن وضع هذا الشخص يمكن أن يضار ﻷي من هذه اﻷسباب .

(ii) that he might, if surrendered, be prejudiced at his trial or punished, detained or restricted in his personal liberty by reason of his race, religion, nationality or political opinions. " .

The State party recalls that Swiss legislation requires that an asylum seeker demonstrate that it is highly probable that he is subjected or rightfully fears being subjected to serious prejudices because of his race, religion, nationality, social affiliations or political opinions.
وتشير الدولة الطرف إلى أن التشريع السويسري يشترط أن يثبت طالب اللجوء أن من المرجح إلى حد كبير أن يتعرض، أو يخشى عن حق أن يتعرض، ﻷذى جسيم بسبب عرقه أو دينه أو جنسيته أو انتمائه الاجتماعي أو آرائه السياسية.

The article provides: " In no case may an alien be deported or returned to a country, regardless of whether or not it is his country of origin, if in that country his right to life or personal freedom is in danger of being violated because of his race, nationality, religion, social status or political opinions " .
وتنص هذه المادة على ما يلي: " لا يجوز بأي حال من الأحوال ترحيل أجنبي أو إعادته إلى بلد، بغض النظر عن كون ذلك البلد بلد منشأه أم لا، إذا كان حقه في الحياة أو الحرية الشخصية معرضا فيه لخطر الانتهاك بسبب عرقه أو جنسيته أو دينه أو مركزه الاجتماعي أو آرائه السياسية``.

1. No one may be expelled or returned (refoulé) to a State where his or her right to life or personal liberty is in danger of being violated because of his or her race, religion, nationality, membership of a particular social group or political opinions.
بلد المقصد 1- لا يجوز طرد شخص أو إعادته قسرياً إلى بلد يكون فيه حقه في الحياة أو الحرية معرضاً للانتهاك على أساس العرق أو الدين أو الجنسية أو وضعه الاجتماعي أو آرائه السياسية.

The Law on Asylum prescribes that no person shall be expelled or returned against his/her will to a territory where his/her life or freedom would be threatened on account of his/her race, sex, language, religion, nationality, association with a social group or political opinions (art. 6, para. 1).

١٤- لا يجوز طرد اللاجئ أو رده على أعقابه إلى مكان تكون فيه حياته أو حريته مهددة بسبب عرقه أو دينه أو جنسيته أو انتمائه إلى فئة اجتماعية معينة أو آرائه السياسية)١٢(.

Refugees are those who have to flee due to a " well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion " (art. 1).
واللاجئ هو كل من اضطر للهرب بسبب " خوف له ما يبرره من التعرض للاضطهاد بسبب عرقه أو دينه أو جنسيته أو انتمائه إلى فئة اجتماعية معينة أو آرائه السياسية " (المادة 1).

The 1951 Convention relating to the Status of Refugees defines a refugee as a person who is outside his/her own GE.02-41058 (E) 190402country " owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion " .
ويجري تعريف اللاجئ في اتفاقية عام 1951 الخاصة بوضع اللاجئين بأنه شخص يعيش خارج بلده " بسبب خوف له ما يبرره من التعرض للاضطهاد بسبب عرقه أو دينه أو جنسيته أو انتمائه إلى فئة اجتماعية معينة أو آرائه السياسية " .

4. Extradition shall not be granted if the requested State Party has substantial grounds for believing that a request for extradition has been made for the purpose of prosecuting or punishing a person on account of his race, religion, [gender], nationality or political opinion, or that a person’s position may be prejudiced for any of these reasons (article 8, paragraph 2, of the Polish draft, as amended).
٤- لا يوافق على التسليم إذا كانت لدى الدولة الطرف المتلقية للطلب أسباب جوهرية تدعو للاعتقاد بأن طلب التسليم قدم بغرض ملاحقة الشخص أو معاقبته بسبب أصله العرقي أو ديانته أو جنسيته أو آرائه السياسية أو بأن وضع هذا الشخص يمكن أن يضار ﻷي من هذه اﻷسباب _الفقرة ٢ من المادة ٨ من المشروع البولندي بعد تعديلها(.
