States parties are to outlaw propaganda and all organizations which are based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin.

Moreover, domestic law contains many provisions prohibiting all kinds of propaganda and organizations based on ideas of superiority of one race or group of persons of one colour or ethnic origin. These include in particular the following:
وفوق ذلك لا تخلو التشريعات الوطنية من الكثير من النصوص التي تحظر جميع أنواع الدعاية والتنظيمات القائمة على الأفكار القائلة بتفوق أي عرق أو أية جماعة من لون أو أصل اثني واحد، ومن بين ذلك ما يلي:

The conduct of a person or group of persons shall be considered an act of the State under international law if the person or group of persons was in fact acting on the instructions of, or under the direction or control of, that State in carrying out the conduct.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي شخص أو أية جماعة من الأشخاص إذا كان الشخص أو جماعة الأشخاص قد تصرفوا في الواقع بناء على تعليمات تلك الدولة أو بتوجيه منها أو تحت رقابتها لدى القيام بذلك التصرف.

The conduct of a person or group of persons shall be considered an act of the State under international law if the person or group of persons was in fact exercising elements of the governmental authority in the absence or default of the official authorities and in circumstances such as to call for the exercise of those elements of authority.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي شخص أو أية جماعة من الأشخاص إذا كان الشخص أو جماعة الأشخاص قد مارسوا في الواقع بعض اختصاصات السلطة الحكومية في غياب السلطات الرسمية أو في حالة عدم قيامها بمهامها وفي ظروف استدعت ممارسة تلك الاختصاصات.

29. The Kingdom's regulations do not permit the establishment of racist organizations or the dissemination of theories based on superiority of one race or group over another, nor do they permit the promotion or incitement of racial discrimination.
29- لا تجيز أنظمة المملكة قيام التنظيمات العنصرية أو النظريات القائلة بتفوق أي عرق أو أية جماعة على ما سواها، ولا تسمح بالترويج للتمييز العنصري أو بالتحريض عليه.

The Committee recalled that article 4 of the Convention requires States parties to penalize four categories of misconduct: (i) dissemination of ideas based upon racial superiority or hatred; (ii) incitement to racial hatred; (iii) acts of violence against any race or group of persons of another colour or ethnic origin; and (iv) incitement to such acts.
وذكَّرت اللجنة بأن المادة 4 من الاتفاقية تطالب الدول الأطراف بتجريم أربع فئات من فئات سوء السلوك هي: `1` بث الأفكار القائمة على التفوق العرقي أو الكراهية؛ `2` التحريض على الكراهية العرقية؛ `3` أعمال العنف ضد أي عرق أو أية جماعة من الأشخاص من لون أو أصـل إثني آخر؛ `4` التحريض على مثل هذه الأعمال.

Every act of violence or incitement to such act committed against any race or group of any colour or other ethnic origin, and any assistance to racist activities, including funding, shall be deemed a criminal offence punishable by law.
يعتبر كل عمل من أعمال العنف أو تحريض على هذه الأعمال يرتكب ضد أي عرق أو أية جماعة من لون أو أصل إثني آخر، وكذلك كل مساعدة للنشاطات العنصرية، بما في ذلك تمويلها، جريمة يعاقب عليها القانون).

In this context, it should be noted that article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination obliges States Parties to condemn all propaganda and any organizations that are based on ideas or theories of the superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote racial hatred and discrimination in any form.
وفي هذا السياق، تجدر الإشارة إلى أن المادة 4 من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري تلزم الدول الأطراف بأن تشجب جميع الدعايات والتنظيمات القائمة على الأفكار أو النظريات القائلة بتفوق أي عرق أو أية جماعة من لون أو أصل إثني واحد، أو التي تحاول تبرير أو تعزيز أي شكل من أشكال الكراهية العنصرية والتمييز العنصري.

(a) Provide for the criminalization of the dissemination of ideas based on racial superiority or hatred, and all acts of violence against any race or group of persons of another colour or ethnic origin, as well as incitement thereto, in accordance with the provisions of article 4 (a) of the Convention;
