6. Under rule 68, paragraph 2, of its rules of procedure, the Committee shall apply the criteria set forth in article 12 of the Convention, recognizing the legal capacity of the author or alleged victim before the Committee, regardless of whether this capacity is recognized in the State party against which the communication is directed.
6- وبموجب الفقرة 2 من المادة 68 من النظام الداخلي للجنة، تطبق اللجنة المعايير المنصوص عليها في المادة 12 من الاتفاقية، التي تعترف لصاحب البلاغ أو الشخص المدعى أنه ضحية بالأهلية القانونية أمام اللجنة، بصرف النظر عن اعتراف الدولة الطرف الموجه ضدها البلاغ بهذه الأهلية أو عدم اعترافها بها.

2. Upon being satisfied that the circumstances so warrant, the State Party in whose territory the offender or alleged offender is present shall take the appropriate measures under its domestic law so as to ensure that person’s presence for the purpose of prosecution or extradition.

4. The rights referred to in paragraph 3 shall be exercised in conformity with the laws and regulations of the State in the territory of which the offender or alleged offender is present, subject to the provision that the said laws and regulations must enable full effect to be given to the purposes for which the rights accorded under paragraph 3 of the present article are intended.

The Secretary-General may request where necessary clarification from the author(s) and/or alleged victim(s) of a communication, including:
1- يجوز للأمين العام أن يطلب عند الضرورة إلى صاحب (أصحاب) البلاغ و/أو الشخص المدعى أنه ضحية (الأشخاص المدّعى أنهم ضحايا) في البلاغ، تقديم توضيحات تشمل ما يلي:

The name, address, date of birth of the author(s) and/or alleged victim(s) and verification of the author's(s' )/ alleged victim's(s' ) identity(ies);
(أ) اسم صاحب البلاغ و/أو الشخص المدعى أنه ضحية وعنوانه وتاريخ ميلاده (أسماء أصحاب البلاغ و/أو الأشخاص المدّعى أنهم ضحايا وعناوينهم وتواريخ ميلادهم)، مع إثبات للهوية؛

Whether the author(s) and/or alleged victim(s) wish their identity(ies) to be revealed in the Committee's final decision pursuant to article 4, paragraph 2, of the Protocol;
(ﻫ) ما إذا كان صاحب (أصحاب) البلاغ و/أو الشخص المدعى أنه ضحية (الأشخاص المدّعى أنهم ضحايا) يرغبون في الكشف عن هوياتهم في قرار اللجنة النهائي وفقاً للفقرة 2 من المادة 4 من البروتوكول؛

The Committee may adopt an appropriate and accessible format, adapted, to the extent possible, to the age and maturity of the child, to facilitate requests for clarification or additional information from the author(s) and/or alleged victim(s) of a communication.
3- ويجوز للجنة اعتماد صيغة مناسبة وميسرة، تكون مكيفة، قدر الإمكان، مع سن الطفل ونضجه، لتيسير طلبات الحصول على التوضيحات أو المعلومات الإضافية من صاحب (أصحاب) البلاغ و/أو الشخص المدعى أنه ضحية (الأشخاص المدّعى أنهم ضحايا) في البلاغ.

Furthermore, " [u]pon being satisfied that the circumstances so warrant, the State Party in whose territory the offender or alleged offender is present shall take the appropriate measures under its domestic law so as to ensure that person's presence for the purpose of prosecution or extradition " (art. 7 (2)), which under many circumstances will be arresting the suspect.
