With respect to losses relating to contracts to which Iraq was not a party, a claimant may prove a direct loss if it can establish that Iraq’s invasion and occupation of Kuwait or the breakdown in civil order in Iraq or Kuwait following Iraq’s invasion caused the claimant to evacuate the personnel needed to perform the contract.
29- وفي ما يتعلق بالخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، يمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق، قد سبب قيام صاحب المطالبة بإجلاء الموظفين اللازمين لتنفيذ العقد.

52- أما بالنسبة للخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، فيمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق قد أجبره على إجلاء الموظفين اللازمين لتنفيذ العقد.

52- أما بالنسبة للخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، فيمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق قد أجبره على إجلاء الموظفين اللازمين لتنفيذ العقد.
