The Committee is concerned that the law permits the deprivation of liberty on the basis of disability and provides for involuntary hospitalization and forced institutionalization of children and adults with intellectual and/or psychosocial disabilities.
28- يساور القلق اللجنة لأنّ القانون يسمح بالحرمان من الحرية على أساس الإعاقة وينص على إرغام الأطفال والبالغين ذوي الإعاقات الذهنية و/أو النفسية الاجتماعية على المكوث في المستشفيات وعلى إيداعهم في مؤسسات الرعاية قسراً.

(c) Revise legislation, policies and practices in the areas of health, leisure, play, culture, and architecture to eliminate physical, economic, legal and cultural factors that may prevent children with physical, sensorial, mental or psychosocial disabilities from exercising all their rights on an equal basis with other children.
(ج) مراجعة التشريعات والسياسات والممارسات في مجالات الصحة والترفيه واللعب والثقافة وهندسة العمارة، من أجل إزالة العوامل المادية والاقتصادية والقانونية والثقافية التي قد تمنع الأطفال ذوي الإعاقات البدنية أو الحسية أو العقلية أو النفسية الاجتماعية من ممارسة جميع حقوقهم بالتساوي مع الأطفال الآخرين.

(a) Ensure that, in practice, there is not any non-consensual sterilization of women with intellectual and/or psychosocial disabilities who have been deprived of their legal capacity or have limited legal capacity, and that those women are provided with the support necessary to decide whether they wish to give their informed consent to sterilization;
(أ) أن تكفل على الصعيد العملي وقف جميع أشكال تعقيم النساء ذوات الإعاقة الذهنية و/أو النفسية الاجتماعية اللاتي حُرمن من الأهلية القانونية أو قُيدت هذه الأهلية، دون رضاهن، وتقديم ما يلزم من دعم لهؤلاء النساء لتمكينهن من اتخاذ قرار بشأن ما إذا كن يرغبن في إعطاء موافقة مستنيرة على إجراء التعقيم؛

(b) Ensure that the necessary resources are available to provide public information in accessible formats, including augmentative and alternative communication for persons with intellectual or psychosocial impairments and accessible information technologies for persons with visual impairments.
(ب) وأن تكفل توفر خدمات الإعلام العام بطرق وأشكال ميسّرة لذوي الإعاقة، بما في ذلك توفير وسائل الاتصال التراكمية والبديلة لذوي الإعاقة الذهنية أو النفسية الاجتماعية وتكنولوجيات المعلومات الميسّرة لذوي الإعاقة البصرية، برصد الميزانية اللازمة لذلك.

The Committee also regrets the lack of available information regarding the number of victims of torture and ill-treatment who may have received compensation and the amounts awarded in such cases, as well as the lack of information about other forms of assistance, including medical or psychosocial rehabilitation, provided to the victims (art. 14).
كما تأسف اللجنة لعدم توافر معلومات تتعلق بعدد ضحايا التعذيب وإساءة المعاملة الذين تلقوا تعويضاً، وبقيمة المبالغ الممنوحة في تلك الحالات، إضافة إلى الافتقار إلى معلومات عن أشكال المساعدة الأخرى المقدمة إلى الضحايا، بما في ذلك إعادة التأهيل من الناحيتين الطبية أو النفسية الاجتماعية (المادة 14).

(c) Adopting positive measures, as appropriate, to increase employment of persons with disabilities in the public and private sectors, in particular for women and youth with disabilities, persons with intellectual or psychosocial disabilities, and ensuring that such positive measures are designed and promoted in a way that recognizes the value of diversity in the workplace and of equal career development for all;
(ج) اتخاذ تدابير إيجابية، عند الاقتضاء، لزيادة توظيف الأشخاص ذوي الإعاقة ولا سيما لصالح ذوي الإعاقة من النساء والشباب وذوي الإعاقة الذهنية أو النفسية الاجتماعية في القطاعين العام والخاص، وضمان وضع هذه التدابير الإيجابية وتعزيزها على نحو يقر بقيمة التنوع في مكان العمل وبالمساواة في التطور الوظيفي للجميع؛
