As regards claims for rental payments for premises in Iraq or Kuwait for the period after 2 March 1991, the Panel finds that the inability of the claimant to benefit from those payments did not result directly from the invasion and occupation of Kuwait.

In view of these results, the Panel found it reasonable to presume that those claimants who were resident in Iraq or Kuwait and who left during the traditional vacation months of June or July 1990 would have returned to those countries had Iraq not invaded Kuwait.
٤٢- وفي ضوء هذه النتائج، رأى الفريق أن من المعقول افتراض أن هؤلاء المطالبين الذين كانوا مقيمين في العراق أو في الكويت والذين غادروا البلدين خلال فترة العطلة العادية في شهري حزيران/يونيه وتموز/يوليه ٠٩٩١ كانوا سيعودون إلى البلدين المذكورين لولا غزو العراق للكويت.

The Panel determined that those claimants who failed to establish the fact of residence in Iraq or Kuwait or the fact of direct interference with an employment relationship outside Iraq or Kuwait by the Iraqi invasion and occupation of Kuwait are not eligible for compensation for C6-Salary losses.
٥٣- ورأى الفريق أن المطالبين الذين قصروا عن إثبات واقعة اقامتهم في العراق أو في الكويت أو واقعة تدخل غزو العراق واحتلاله للكويت تدخلاً مباشراً في علاقة عملهم خارج العراق أو الكويت، ليسوا مؤهلين للحصول على التعويض في إطار الفئة جيم/٦ المتعلقة بالخسائر من المرتبات.

An electronic survey of these claims demonstrated that most claimants also provided enough additional information on the “C6 " page to create a presumption that they could confirm the fact of their employment in Iraq or Kuwait.More than 68 per cent of these claimants provided other information on the “C6 " page relevant to the number of months employed and/or country of employment.

However, the Panel determined that those claims for which additional information could not be ascertained from the electronic “C6” page in order to create the presumption that the claimants’ employment in Iraq or Kuwait could be confirmed would not be compensated for C6-Salary losses.

Thus, consistent with the causation categories enumerated in decision 1, and taking into account the data contained in the external reports, Ibid., p. 98, note 172, p. 116, note 221, and p.117, note 244. the Panel considered it realistic to presume that a substantial number of the deaths occurring in Iraq or Kuwait during this period were likely to be attributable to Iraq’s activities associated with the invasion and occupation.

Thus, the Panel concluded that if a claimant had established the fact of residency in Iraq or Kuwait prior to the invasion and had provided some information confirming the fact of that employment, the claimant had proven the fact of employment in Iraq or Kuwait.

After manual review, businesses in the majority of claims were found either to be physically located in Iraq or Kuwait or the claimants’ losses were directly attributable to their being held hostage or forced to hide in Iraq or Kuwait.
