101. The Committee notes with concern that the obligation established in article 14, paragraph 3 (f), of the Covenant to provide an interpreter for everyone charged with a criminal offence if he cannot understand or speak the language used in court is not reflected in the criminal legislation of all the cantons.
١٠١ - وتلاحظ اللجنة بقلق أن جميع التشريعات الجنائية للكانتونات لا تعكس الالتزام المنصوص عليه في الفقرة ٣ )و( من المادة ٤١ من العهد وهو الالتزام الذي يقضي بتوفير ترجمان ﻷي شخص يتهم بجريمة جزائية إذا كان لا يفهم أو لا يتكلم اللغة المستخدمة في المحكمة.

40. The right to have the free assistance of an interpreter if the accused cannot understand or speak the language used in court as provided for by article 14, paragraph 3 (f) enshrines another aspect of the principles of fairness and equality of arms in criminal proceedings.
40- كما أن الحق في تزويد المتهم بترجمان مجانا إذا كان لا يفهم أو لا يتكلم اللغة المستخدمة في المحكمة، على نحو ما ورد في الفقرة 3(و) من الفقرة 14، يجسد جانباً آخر من جوانب العدل وتكافؤ الفرص القانونية في المحاكم الجنائية().

The right to have the free assistance of an interpreter if the accused cannot understand or speak the language used in court as provided for by article 14, paragraph 3 (f) enshrines another aspect of the principles of fairness and equality of arms in criminal proceedings.
