Mr. Inoue (Japan) said that the wording of draft article 4, paragraph (1), stating that conciliation proceedings commenced " on the day on which the parties to the dispute agree to engage in conciliation proceedings " , was unclear, because parties might agree in principle to conciliate even before a particular dispute arose.
15- السيد إنوي (اليابان): قال إن صيغة الفقرة (1) من مشروع المادة 4، التي تذكر أن إجراءات التوفيق تبدأ " في اليوم الذي يتفق فيه طرفا النـزاع على المشاركة في إجراءات توفيق " ، غير واضحة، لأن الطرفين قد يتفقان من حيث المبدأ على التوفيق حتى قبل أن ينشأ نزاع محدد.

Although the provision was deleted, the Commission agreed that the Model Law was not intended to indicate whether or not an arbitrator could act or participate in conciliation proceedings relating to the dispute and that this was a matter left to the discretion of the parties and arbitrators acting within the context of applicable law and rules (A/CN.9/506, para.132).
