It should be stressed that Ethiopia’s continued occupation of sovereign Eritrean territory and its publicly declared “regime change” through subversive means are all flagrant violations of the Charter of the United Nations and continue to act as impediments to better bilateral relationships and better cooperation for regional peace and security.

وعندما تظل أراض إريترية ذات سيادة ترزح تحت وطأة احتلال إثيوبيا لها عقب الحرب، علما بأنها ربما تفكر في القيام بمزيد من الأعمال العدوانية، هل نسي فريق الرصد أن لإريتريا حقوقا مشروعة في الدفاع عن نفسها، على النحو المنصوص عليه في المادة 51 من ميثاق الأمم المتحدة؟

1. Occupation of sovereign Eritrean territories
1- احتلال أراض إريترية ذات سيادة

91. One of the main constraints of the Government of Eritrea to fulfill its international and national obligations in promoting and protecting Human Rights and Fundamental Freedoms is the continued occupation of sovereign Eritrean Territories by Ethiopia.
91- تتمثل إحدى العقبات التي تعترض وفاء حكومة إريتريا بالتزاماتها الدولية فيما يتعلق بتعزيز وحماية حقوق الإنسان والحريات الأساسية في احتلال إثيوبيا المستمر لأراض إريترية ذات سيادة.

(a) The Ethiopian regime has flaunted international law, the Charter of the United Nations, and its treaty obligations to occupy sovereign Eritrean territories for the last 10 years.
(أ) إن النظام الإثيوبي ضرب عرض الحائط بالقانون الدولي، وميثاق الأمم المتحدة، والتزاماته التعاهدية باحتلال أراضٍ إريترية ذات سيادة على مدى العشر سنوات الماضية.

(3) The events over the past year have clearly shown that it is in fact Ethiopia that is actively engaged in destabilizing Eritrea in addition to its continued occupation of sovereign Eritrean territory in violation of the United Nations Charter;
(3) أظهرت الأحداث التي وقعت خلال العام الماضي بوضوح أن إثيوبيا هي في الواقع من يعمل بنشاط على زعزعة استقرار إريتريا، إضافة إلى استمرار احتلالها لأراض إريترية ذات سيادة في انتهاك لميثاق الأمم المتحدة؛

It is saddening, once again, to witness silence on the part of the Security Council at Ethiopia's rejection of the Eritrea-Ethiopia Boundary Commission's award, in accordance with the Algiers Peace Agreements, and the continued occupation by Ethiopia of sovereign Eritrean territories under the influence of some members.
ومن المحزن مرة أخرى أن نشهد اعتصامَ مجلس الأمن بالصمت إزاء رفض إثيوبيا الحكم الصادر عن لجنة الحدود الإريترية - الإثيوبية، وفقاً لاتفاقي الجزائر للسلام، واستمرارَ احتلال إثيوبيا أراضٍ إريترية ذات سيادة في ظل نفوذ بعض الأعضاء.

In addition, the UN Security Council has not only failed to assume its legal and moral obligations to tolerate with impunity Ethiopia's occupation of sovereign Eritrean territories in violation of the UN Charter, international law and the final and binding arbitral ruling of the Eritrea Ethiopia Boundary Commission for the past 11 years but it has imposed unwarranted sanctions against Eritrea under the prodding of the United States.
وعلاوة على ذلك، لم يكتف مجلس أمن الأمم المتحدة خلال السنوات الإحدى عشرة الماضية بعدم تحمل مسؤوليته القانونية والأخلاقية وتغاضيه عن الاحتلال الإثيوبي لأراض إريترية ذات سيادة دون رادع منتهكاً بذلك ميثاق الأمم المتحدة والقانون الدولي والقرار التحكيمي النهائي والملزم قانوناً الصادر عن لجنة ترسيم الحدود بين إريتريا وإثيوبيا، وإنما فرض أيضاً عقوبات غير مبررة على إريتريا بتحريض من الولايات المتحدة.

In the last couple of days since Ethiopia occupied Tesseney, more than 15,000 villagers have been uprooted from their homelands in Awgaro, Aarekeb, Debro, Adi Bgidi, Augomo, Germen, Maishglen, Antore and Biko in the Gash-Setit region by the Ethiopian army, which has confiscated their cattle, looted other property and burned most of the villages. The Gash-Setit region is undisputed sovereign Eritrean territory.
وخلال اليومين الأخيرين منذ احتلال إثيوبيا لتيسيني، اقتلع الجيش الإثيوبي أكثر من 000 15 قروي من أوطانهم في أوغارو وآيريكيب ودبرو وآدي بغيدي وآوغوو وجيرمين ومايشغلن وأنتور وبيكو الواقعة في منطقة غاش - سيتيت، وقام بمصادرة مواشيهم ونهب غيرها من الممتلكات وحرق معظم القرى علما بأن منطقة غاش - سيتيت أرض إريترية ذات سيادة وغير متنازع عليها.

As we have explained in the past, resolution 1907 (2009) imposes on Eritrea an arms embargo while Eritrea remains a victim of Ethiopian aggression, with the latter occupying sovereign Eritrean territories in flagrant breach of international law; the African Union Charter on the sanctity of colonial boundaries; and relevant United Nations articles on the resolution of territorial disputes through arbitral mechanisms.
