It was suggested that any amendment to the UNCITRAL Arbitration Rules be made effective as from the date of coming into effect of the transparency rules, as a number of treaties concluded since 2010 have included a reference to the 2010 UNCITRAL Arbitration Rules, and the Parties to such treaties did not necessarily intend to include rules on transparency.

31- لعلَّ اللجنة تود أن تلاحظ أن إرساء قواعد الأونسيترال للتحكيم لعام 2013، التي ترتبط بقواعد الشفافية، سيكون له بالضرورة تأثير على الإشارات إلى قواعد الأونسيترال للتحكيم الواردة في المعاهدات المبرمة بعد بدء نفاذ قواعد الشفافية.

Article 1(1) and 1(2) reflect the compromise struck specifically with respect to references to the UNCITRAL Arbitration Rules in future and existing treaties.

It was suggested that a reference in investment treaties to the " UNCITRAL Arbitration Rules " without any further indication of a version of the Rules could be interpreted as a " dynamic reference " , encompassing further possible evolution of the Rules.
20- ورُئي أنَّ الإشارة في معاهدات الاستثمار إلى " قواعد الأونسيترال للتحكيم " دون أيِّ إشارة إضافية إلى صيغة من تلك القواعد قد تُفسر على أنَّها " إشارة دينامية " ، تشمل أيَّ تطوّرات إضافية قد تطرأ على تلك القواعد.

It was said that the presumption in paragraph (2) that the transparency rules would apply when the investment treaty contained a reference to the UNCITRAL Arbitration Rules raised questions as to the form that the transparency rules would take.
40- وقيل إنَّ الافتراض الوارد في الفقرة (2) بشأن انطباق قواعد الشفافية عندما تُدرَج في معاهدة الاستثمار إشارةٌ إلى قواعد الأونسيترال للتحكيم يثير تساؤلات بشأن الشكل الذي ستتخذه قواعد الشفافية.

Questions were raised as to the binding effect legal standards on transparency might have on arbitration provisions referring to the UNCITRAL Arbitration Rules in existing investment treaties, in particular for those arbitration provisions that did not specify the applicable version of the Rules.
27- وطُرحت تساؤلات بشأن ما قد يكون للمعايير القانونية بشأن الشفافية من مفعول ملزم في أحكام التحكيم التي تشير إلى قواعد الأونسيترال للتحكيم في المعاهدات الاستثمارية القائمة، وخصوصاً أحكام التحكيم التي لم تُحدّد صيغة القواعد المنطبقة.

Specifically, it was clarified that a reference to the UNCITRAL Arbitration Rules as adopted in 1976, or as revised in 2010, in a treaty concluded after the coming into force of the rules on transparency would have the effect of precluding the application of the rules on transparency (A/CN.9/783, para. 31).

With respect to the revised proposal, it was observed that paragraph (1) did not exclude a dynamic interpretation of a reference to the UNCITRAL Arbitration Rules in existing investment treaties, as it only referred to the agreement of the parties to apply the rules on transparency.
48- ولوحظ فيما يتعلق بالمقترح المنقّح أنَّ الفقرة (1) لا تستبعد تفسير الإشارة في معاهدات الاستثمار الحالية إلى قواعد الأونسيترال للتحكيم تفسيراً دينامياً، إذ إنها تشير فقط إلى اتفاق الأطراف على تطبيق قواعد الشفافية.
