The GGE did not conclude its negotiations on document CCW/GGE/2008-V/WP.1 and recommended to the Meeting of the High Contracting Parties that possible further negotiations take place in 2009, without prejudice to any present or future proposals made by delegations.

Mr. Akram (Pakistan) said that the 2010 Meeting of the High Contracting Parties to the Convention was of special significance in that it would set the tone for the Fourth Review Conference, to be held in 2011, thereby laying the groundwork for future action.

24. The Chairperson recalled that the 2007 Meeting of the High Contracting Parties had decided to keep the issue of mines other than anti-personnel mines (MOTAPM) under consideration, under the overall responsibility of the Chairperson-designate (CCW/MSP/2007/5, para. 36).
24- الرئيس ذكّر بأن اجتماع الأطراف السامية المتعاقدة في عام 2007 قرر مواصلة النظر في مسألة الألغام غير الألغام المضادة للأفراد تحت المسؤولية العامة للرئيس المعيّن (CCW/MSP/2007/5، الفقرة 36).

Given that the Group of Governmental Experts had not been able to reach a consensus on the most important provisions of the draft protocol, namely, the requirements for the prohibition of the use, stockpiling and maintenance of cluster munitions, the Group's mandate should be extended until 2011 in the hope that a draft protocol could be agreed on and submitted for adoption to the next Meeting of the High Contracting Parties.
ونظراً لعدم تمكن فريق الخبراء الحكوميين من التوصل إلى توافق في الآراء بشأن أهم أحكام مشروع البروتوكول، ألا وهو متطلبات حظر استخدام وتكديس وصيانة الذخائر العنقودية، ينبغي تمديد ولاية الفريق حتى عام 2011 أملاً في أن يتم التمكن من الاتفاق على مشروع بروتوكول ويتم طرحه على اجتماع الأطراف السامية المتعاقدة القادم لاعتماده.

(b) The Committee shall inform the High Contracting Party concerned about its draft conclusions and recommendations and the latter may provide additional comments, which shall be included in the report, referred to in paragraph 14 of this Article, which the Committee submits to the Meeting of the High Contracting Parties set out in Paragraph 3 of this Article.
(ب) تبلغ اللجنة الطرف المعني بمشروع استنتاجاتها وتوصياتها، ويمكن لهذا الطرف أن يقدم معلومات إضافية تُدرج في التقرير، المشار إليه في الفقرة 14 من هذه المادة، الذي تقدمه اللجنة إلى اجتماع الأطراف السامية المتعاقدة الواردة في الفقرة 3 من هذه المادة.

14. (a) The Committee shall submit a report to the Meeting of the High Contracting Parties, set out in paragraph 3 of this Article, including nil-reports if applicable, presenting the work that the Committee has undertaken in promoting compliance with the Convention and its annexed Protocols.
14- (أ) تقدم اللجنة تقريراً إلى اجتماع الأطراف السامية المتعاقدة الواردة في الفقرة 3 من هذه المادة، بما في ذلك تقارير صفرية إذا لزم الأمر، لعرض الأعمال التي اضطلعت بها لتعزيز الامتثال للاتفاقية وللبروتوكولات الملحقة بها.

(b) The Committee shall include in its report a summary of all submissions and, where appropriate, a summary of the explanations and statements of the High Contracting Parties concerned, as well as its own suggestions and recommendations for information, consideration and necessary action by the Meeting of the High Contracting Parties, set out in Paragraph 3 of this Article.
(ب) تدرج اللجنة في تقريرها موجزاً لجميع العروض، وحيثما كان ذلك مناسباً، تدرج موجزاً لتوضيحات وبيانات الأطراف المعنية، فضلاً عن اقتراحات اللجنة وتوصياتها المتعلقة بطلب معلومات ينظر فيها اجتماع الأطراف السامية المتعاقدة الواردة في الفقرة 3 من هذه المادة ويتخذ الإجراء اللازم بشأنها.

21. Mr. de Macedo Soares (Brazil) said that the Meeting of the High Contracting Parties provided an opportunity to work to ensure the continued and strengthened implementation of the Convention, which was an important legal instrument both in the area of arms control and in that of international humanitarian law.
21- السيد دي ماسيدو سوارس (البرازيل) قال إن اجتماع الأطراف السامية المتعاقدة مناسبة للعمل على متابعة وتعزيز تنفيذ الاتفاقية التي تمثل صكاً قانونياً هاماً سواء في مجال تحديد الأسلحة أو في مجال القانون الإنساني الدولي.

He urged all States represented at the Meeting of the High Contracting Parties to end negotiations on such a draft protocol, to accede to the Convention on Cluster Munitions and to adopt without delay national measures to restrict the use, production and transfer of those weapons, following the example of other States.
ومضى يقول إنه يحث الدول الممثلة في اجتماع الأطراف السامية المتعاقدة على التخلّي عن فكرة الدخول في مفاوضات حول مثل هذا البروتوكول وعلى أن تختار الانضمام إلى اتفاقية الذخائر العنقودية وعلى أن تبادر فوراً، على غرار ما فعلته بعض الدول، إلى اتخاذ تدابير على الصعيد الوطني بغية تقييد استعمال وإنتاج ونقل تلك الأسلحة.

The European Union, with the aim of concluding a legally binding instrument that prohibits the use, production, transfer and stockpiling of cluster munitions that cause unacceptable harm to civilians and includes provisions on cooperation and assistance, submits the following proposal for a negotiating mandate on cluster munitions to be recommended by the GGE for adoption by the Meeting of the High Contracting Parties to the CCW in November 2007:
بهدف إبرام صكّ ملزم قانوناً يحظر استعمال وإنتاج ونقل وتخزين الذخائر العنقودية التي تتسبب في إلحاق أذى غير مقبول بالمدنيين، ويتضمّن أحكاماً بشأن التعاون والمساعدة، يقدّم الاتحاد الأوروبي المقترح التالي بشأن ولاية تفاوضية بشأن الذخائر العنقودية يوصي فريق الخبراء الحكوميين اجتماع الأطراف السامية المتعاقدة في الاتفاقية باعتمادها في تشرين الثاني/نوفمبر 2007:

Pursuant to the relevant decision of the Meeting of the High Contracting Parties to appoint " a representative of the Western European and Others Group as Chairperson of the Group of Governmental Experts " as contained in paragraph 41 of its Report (CCW/MSP/2007/5), the Group of Governmental Experts was chaired by Ambassador Bent Wigotski of Denmark.
2- وعملاً بالقرار المعني الذي اتخذه اجتماع الأطراف السامية المتعاقدة لتعيين " ممثل لمجموعة دول أوروبا الغربية ودول أخرى ليكون رئيساً لفريق الخبراء الحكوميين " على النحو المبين في الفقرة 41 من تقريره (CCW/MSP/2007/5)، فقد ترأس السفير بينت ويغوتسكي (الدانمرك) فريق الخـبراء الحكـوميين .

42. The Chairperson, recalling the terms of the mandate given by the 2009 Meeting of the High Contracting Parties to the Group of Governmental Experts in relation to the Group's negotiations on cluster munitions (CCW/MSP/2009/5, para. 40), invited comments on the work of the Group on that issue, noting that most delegations had already spoken on the subject during the exchange of general views.
42- الرئيس ذكّر بشروط الولاية التي منحها اجتماع الأطراف السامية المتعاقدة المنعقد عام 2009 لفريق الخبراء الحكوميين فيما يخص المفاوضات التي يجريها هذا الأخير بشأن الذخائر العنقودية (الوثيقة CCW/MSP/2009/5، الفقرة 40)، ودعا الوفود إلى إبداء كل الملاحظات التي ترى أنها مناسبة على أعمال الفريق حول هذه المسألة، ولاحظ أن معظم الوفود تصدّت لهذه المسألة خلال التبادل العام للآراء.
