The State Party in whose territory the alleged offender is found shall, if it does not extradite him, be obliged, without exception whatsoever and whether or not the offence was committed in its territory, to submit the case to its competent authorities for the purpose of prosecution, through proceedings in accordance with the laws of that State.
تكون الدولة الطرف، التي يوجد في إقليمها الشخص المنسوب إليه ارتكاب الجريمة، إذا لم تقم بتسليمه، ملزمة، دون استثناء على الإطلاق وسواء ارتكبت الجريمة أو لم ترتكب في إقليمها، بأن تعرض الأمر على سلطاتها المختصة لغرض المحاكمة، عن طريق إجراءات تتخذ وفقا لقوانين تلك الدولة.

1 - إذا لم تقم الدولة الطرف التي يوجد في إقليمها الشخص المدعى ارتكابه الجريمة بتسليم ذلك الشخص فإنها تكون ملزمة في الحالات التي تنطبق عليها المادة 9، وبدون أي استثناء على الإطلاق وسواء كانت الجريمة قد ارتكبت أو لم ترتكب في إقليمها، بأن تحيل القضية دون إبطاء لا لزوم له إلى سلطاتها المختصة بقصد المحاكمة من خلال إجراءات تتفق وقوانين تلك الدولة.
