The Judicial Perspective was updated in 2013 to reflect the revisions to the Guide to Enactment of the Model Law adopted by the Commission in 2013 as the Guide to Enactment and Interpretation of the Model Law and to include recent jurisprudence applying and interpreting the Model Law.

2. The Secretariat established a board of experts to advise on updating The Judicial Perspective to take account of recent jurisprudence interpreting the Model Law on Cross-Border Insolvency and to reflect revisions being prepared to the Guide to Enactment of the Model Law.

For such cases, it was suggested that the Guide should draw the attention of enacting States to the need to clarify in the piece of legislation enacting the Model Law whether such conciliation should be governed by that piece of legislation or not.

8. Mr. Sekolec (Secretary of the Commission) introduced conference room paper A/CN.9/XXXV/ CRP.3 setting forth proposed changes in the text in the event that States wished to enact the Model Law to apply to domestic as well as international conciliation.

The Commission took note with satisfaction of the report on developments with enactments of the Model Law.

A view was stated that the language of the text of article 9, as elaborated upon by the Guide, would set up standards that were not based on market practice and were not employed by any major certification service provider, could not be met and would set barriers to the enactment of the Model Law.
وأعرب عن رأي مفاده أن لغة نص المادة 9، حسبما تناولها الدليل من شأنها أن تضع معايير لا تستند الى ممارسات السوق ولا يستخدمها أي مقدم رئيسي لخدمات التصديق، ولا يمكن استيفاؤها وأن تضع عوائق أم اشتراع القانون النموذجي.

The Working Group discussed the draft guide to enactment of the draft Model Law on the basis of the notes prepared by the Secretariat (A/CN.9/WG.IV/WP.86 and WP.86/Add.1).
