Article 12 of the Convention states that every child capable of forming views has the right to express those views freely in all matters affecting him or her and that those views must be given due weight in accordance with the child's age and maturity.

However, article 12 expressly articulates States Parties' obligations to " assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child " .
غير أن المادة 12 تنص صراحة على أن ' ' تكفل الدول الأطراف في الاتفاقية للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقا لسن الطفل ونضجه``.

5. Also calls upon States parties to assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views being given due weight in accordance with the age and maturity of the child;
5- تطلب أيضاً إلى الدول الأطراف أن تكفل للأطفال غير القادرين على تكوين آرائهم الحق في الإعراب عن هذه الآراء بحرية في جميع المسائل التي تؤثر عليهم، وأن يُعطى لهذه الآراء الوزن الواجب إعطاؤه لها حسب عمر الطفل ونضجه؛

Article 12 recognizes the rights of children and young people to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.

474. The right of all children to express their own opinion is guaranteed primarily in article 12 of the Convention on the Rights of the Child which safeguards to all children able to formulate their own views the right to express such views freely in all matters concerning them, whereas due consideration must be given to the child's views consistent with its age and level of cognitive development.
474- وحق جميع الأطفال في التعبير عن آرائهم مكفول أساساً في المادة 12 من اتفاقية حقوق الطفل التي تكفل لجميع الأطفال القادرين على تكوين آرائهم الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمسّهم، وتُولى آراء الأطفال الاعتبار الواجب وفقاً لسنهم ونضجهم.

25. Paragraph 1 of the article accords to the child who is capable of forming his or her views the right to express those views freely in all matters affecting him or her, and the subsequent right to have those views given due weight in accordance with his or her age and maturity.
٢٥ - فالفقرة 1 من المادة تمنح الطفل القادر على تكوين آرائه الخاصة حق التعبير عن هذه الآراء بحرية في جميع المسائل التي تمس الطفل، والحق التالي المتعلق بإيلاء آراء الطفل الاعتبار الواجب وفقا لسنه ونضجه.

Such a case-by-case approach is also supported by article 12 (1) of the Convention on the Rights of the Child, which requests States parties to " assure to the child who is capable of forming his or her own views to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child " .
