Civil Status and Civil Registration Act (law No. 48 of 1991)
قانون الأحوال المدنية والسجل المدني رقم 48 لسنة1991

A recently enacted law (law No. 23 of 2003) amending the Civil Status and Civil Registration Act contains the following provisions:
وقد صدر مؤخراً القانون رقم 23 لسنة 2003 بشأن الأحوال المدنية والسجل المدني على النحو التالي:

104. A training centre attached to the Department of Civil Status and Civil Registration was established in 2007 and has since run several training courses for personnel working in different fields in civil registry offices.
104- تم في العام 2007 تأسيس مركز تدريب يتبع مصلحة الأحوال المدنية والسجل المدني.

Consultations were held with the Department of Civil Status and Civil Registration on mechanisms for improving and developing the birth registration system. This will help to curb the practice of forging children's and smugglers' identity documents.
عقد لقاءات تشاوريه مع مصلحة الأحوال المدنية والسجل المدني لمناقشة الآليات والسبل الكفيلة بتفعيل نظام تسجيل المواليد وتطوير آلياته وهذا سيساهم في الحد من عمليات تزوير الوثائق الشخصية للأطفال والمهربين؛

Article 1. Articles 21, 47, 61 and 62 of the republican decree containing law No. 48 of 1991 concerning Civil Status and Civil Registration are amended as follows:
المادة 1- تعدل المواد 21 و47 و61 و62، من القرار الجمهوري بالقانون رقم 23 لسنة 1991 بشأن الأحوال المدنية والسجل المدني على النحو التالي:

Article 10 of the Act provides that every child has the right to have a name that distinguishes him, and that that name shall be inscribed at the time of his birth in a register of births, in accordance with the terms of the Civil Status and Civil Registration Act.
349- كما تضمنت المادة 10 من القانون المذكور أن لكل طفل الحق في أن يكون لـه اسم يميزه يسجل عند الميلاد في سجلات المواليد وفقاً لأحكام قانون الأحوال المدنية والسجل المدني.

68. Article 47 of the same Act provides that official records and notifications of births and deaths shall be regulated by the Civil Status and Civil Registration Act.
68- ونصت المادة 47 من نفس القانون على أن السجلات الرسمية للمواليد والوفيات والتبليغات الخاصة بها ينظمها قانون الأحوال المدنية والسجل المدني.

87. Article 21 of the Civil Status and Civil Registration Act was also amended to include both parents of the child among those qualified to give information concerning the birth, whereas only the child's father, if present, was previously qualified to do so.
87- كما تم تعديل المادة 21 من قانون الأحوال المدنية والسجل المدني بحيث التي جعلت أحد والدي الطفل من المكلفين بالتبليغ عن مولده بعد أن كانت محصورة بوالد الطفل إذا كان حاضراً.

Article 22 of the Civil Status and Civil Registration Act No. 23 of 1991 provides that: " The information given must include the following particulars:
حيث نصت المادة 22 من القانون رقم 23 لسنة 1991 بشأن الأحوال المدنية والسجل المدني أنه " يجب أن يشتمل التبليغ على البيانات الآتية:

As explained in our previous report, every child, as soon as he is born, has the right to have his birth inscribed in the register of births and to have a specific name by which he is known. That is a right that is guaranteed by law under the Civil Status and Civil Registration Act (law No. 23 of 1991).

82. In order to prevent any stigma or discrimination against the child, articles 37, 38, 39, 45 and 48 of the Civil Code and articles 20, 21, 23, 25, 26, 27, 29 and 30 of the Civil Status and Civil Registration Act affirm protection for the rights of the child and prohibit discriminatory practices to which the child may be subjected.
٨٢- ولمنع أي وصم للطفل أو التمييز ضده، أكد القانون المدني في المواد ٣٧، و٣٨، و٣٩، و٤٥، و٤٨ وكذلك قانون الأحوال المدنية والسجل المدني في المواد ٢٠، و٢١، و٢٣، و٢٥، و٢٦، و٢٧، و٢٩، و٣٠ حماية حقوق الطفل ومنع الممارسات التمييزية التي يمكن أن يتعرض لها.

تم عقد لقاء تشاوري خلال شهر أيلول/سبتمبر 2006 بالتنسيق مع مصلحة الأحوال المدنية والسجل المدني لمناقشة الآليات والسبل الكفيلة بتفعيل نظام تسجيل المواليد وتطوير آلياته وهذا سيساهم في الحد من عمليات تزوير الوثائق الشخصية للأطفال والمهربين؛

Promulgation of Act No. 23 of 2003 amending the Republican Decree enacted by Act No. 23 of 1991 concerning Civil Status and Civil Registration to ensure that births are registered and that birth certificates are issued free of charge
صدور القانون رقم (23) لسنة 2003م، بتعديل القرار الجمهوري بالقانون رقم (23) لسنة 1991م، بشأن الأحوال المدنية والسجل المدني بما من شأنه كفالة قيد المواليد في السجلات وإصدار شهادات ميلاد للطفل مجاناً.

(d) The National Strategy for Modernization and Development of the Department of Civil Status and Civil Registration (2008 - 2010) was approved, based on the outputs of the analysis of the current status of civil registration and the findings drawn from the Omani experience and from national pilot schemes in this sphere;
(د) إقرار الاستراتيجية الوطنية لتحديث وتطوير الأحوال المدنية والسجل المدني خلال الفترة 2008-2015، بناءً على مخرجات تحليل الوضع الراهن للسجل المدني، والنتائج المستفادة من التجربة العمانية والتجارب الوطنية في هذا المجال.

(c) Consultations were held with the Department of Civil Status and Civil Registration on mechanisms for improving and developing the birth registration system. This will help to curb the practice of forging children's and smugglers' identity documents;
(ج) عقد لقاءات تشاوريه مع مصلحة الأحوال المدنية والسجل المدني لمناقشة الآليات والسبل الكفيلة بتفعيل نظام تسجيل المواليد وتطوير آلياته وهذا سيساهم في الحد من عمليات تزوير الوثائق الشخصية للأطفال والمهربين؛

Article 49 of the Civil Status and Civil Registration Act provides that every citizen of the Republic of Yemen, upon reaching the age of 16 years, shall be issued a personal identity card, or a family identity card if he is the head of a family. Article 11 of the Children's Rights Act provides that every child is entitled to citizenship in accordance with the terms of the Act and other applicable legislation.
352- وأقر قانون الأحوال المدنية والسجل المدني في المادة 49 بأنه يجب على كل شخص من مواطني الجمهورية اليمنية متى بلغ السادسة عشر من عمره أن يحصل على بطاقة شخصية أو بطاقة عائلية إذا أصبح رب أسره، وأكدت المادة 11 من قانون حقوق الطفل أن لكل طفل الحق بأن يكون لـه جنسية وفقاً لأحكام هذا القانون والقوانين النافذة.

86. As part of the comprehensive revision of national laws and the review of parts relating to children's rights, article 21 of the Civil Status and Civil Registration Act No. 23 of 1991 was amended by Act No. 23 of 2003, pursuant to which articles were either modified or added. These included article 6 bis, which provides that: " A national serial numbering system shall be introduced and a number shall be given to all citizens. "
86- في إطار المراجعة الشاملة لعدد من القوانين الوطنية وإعادة النظر فيما له الصلة بحقوق الطفل تم تعديل المادة 21 من القانون رقم 23 لسنة 1991 بشأن الأحوال المدنية والسجل المدني بالقانون رقم 23 لسنة 2003 الذي عُدّل وأضاف بعض المواد، والتي منها ما يلي المادة (6 مكرر) التي تنص على أنه " يتم استحداث نظام الرقم الوطني وبالتسلسل ويمنح مركزياً لجميع المواطنين " .
