41. Mr. Rosenthal suggested the following strategies that could be used for combating and prosecuting racist activities on the Internet:

In addition, a committee had been mandated to look into ways of strengthening legal protection against racism and had drawn up a report containing proposals for developing a new law prohibiting ethnic discrimination, incorporating the International Convention on the Elimination of All Forms of Racial Discrimination into domestic legislation and prohibiting organized racist activities.

Ms. Jöel Sambuc, Vice-Chairperson of the Federal Commission against Racism (Switzerland) referred to her working paper (HR/GVA/WCR/SEM.1/2000/WP.3) and stated her view that racist activity on the Internet should be subject to the same rules that were applicable to other forms of racist activities.

23. The Simon Wiesenthal Centre, which is specialized in the monitoring of online racist activities, recently released a CD-ROM entitled " Digital Hate " , which lists the sites engaged in racist propaganda.

The Committee takes note of the State party's observation that a formal ban on organizations might not be very effective in combating racism, owing to the fact that the groups involved in most of the racist activities are loose networks and not formal organizations.
475- وتحيط اللجنة علماً بملاحظة الدولة الطرف أن حظراً رسمياً على المنظمات قد لا يكون فعالاً لمكافحة العنصرية، باعتبار أن المجموعات المورطة في معظم الأنشطة العنصرية هي في واقع الأمر شبكات مفككة وليست منظمات رسمية.

(13) The Committee remains concerned: (a) at the refusal by the State party to introduce in its legislation a specific offence criminalizing and punishing acts of racist violence; and (b) at the State party's approach to prohibit racist activities of racist organizations rather than prohibiting and declaring illegal such organizations (art. 4).
(13) ولا يزال يساور اللجنة القلق مما يلي: (أ) رفض الدولة الطرف تضمين قوانينها نصاً جنائياً محدداً يجرم أفعال العنف العنصري ويعاقب عليها؛ (ب) ونهج الدولة الطرف المتمثل في حظر الأنشطة العنصرية للمنظمات العنصرية عوضاً عن حظر مثل هذه المنظمات وإعلانها منظمات غير قانونية (المادة 4).

His delegation welcomed the report of the Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 on implementation of General Assembly resolution 60/251 (A/HRC/4/17), which described some of the racist activities of the occupying Power.

The Swedish position is that the provisions on agitation against a national or ethnic group, unlawful military activity, inciting rebellion, conspiracy and preparation, attempt and complicity in crimes contained in the Penal Code mean that organisations engaged in racist activities cannot pursue such activities without breaking the law.

A number of provisions in Swedish law, notably the provisions prohibiting " incitement against a national or ethnic group " and " unlawful military activity " and provisions on conspiracy, preparation, attempt and complicity in crimes, meant that organizations engaged in racist activities could not pursue such activities without breaking the law.
