تعليقات أوّلية على المادة الأولى من الاتفاقية

" Hostile use " is a clear allusion to Article I of the Convention and covers both State and non-State actors.
في الأغراض العدائية " إشارة واضحة إلى المادة الأولى من الاتفاقية وتشمل الجهات الفاعلة من الدول وغير الدول معاً.

:: Amending the Penal Code to include an explicit definition of torture identical to the one set forth in Article I of the Convention against Torture;

The Sixth Review Conference also reaffirmed that Article I of the Convention applies to all S & T developments in the life sciences and in other fields of science relevant to the Convention.

ولذلك فإن أي حجة تستند إلى تردد الدول الأطراف في تعديل المادة الأولى من الاتفاقية بحيث تتضمن حظراً صريحاً لاستعمال الأسلحة آنفة الذكر قد لا تبدو مقنعة.

The Conference welcomes statements made by States Parties that they do not possess agents, toxins, weapons, equipment or means of delivery prohibited by Article I of the Convention.
5- ويرحب المؤتمر بالبيانات الصادرة عن الدول التي أصبحت أطرافاً في الاتفاقية بأنها لا تمتلك عوامل أو تكسينات أو أسلحة أو معدات أو وسائل إيصال مما هو محظور في المادة الأولى من الاتفاقية.

6. The Fourth Review Conference affirmed that the use by States Parties, in any way and under any circumstances, of microbial or other biological agents or toxins, that is not consistent with prophylactic, protective or other peaceful purposes, is effectively a violation of Article I of the Convention. [IV.I.3]
6- وأكد المؤتمر الاستعراضي الرابع أن استعمال الدول الأطراف للعوامل الجرثومية أو العوامل البيولوجية الأخرى أو التكسينات بأي وسيلة وتحت أي ظروف، على نحو لا يتسق مع أغراض الوقاية أو الحماية أو غيرها من الأغراض السلمية هو فعلياً انتهاك للمادة الأولى من الاتفاقية. [IV.I.3]

They also reaffirmed that the use by the States Parties, in any way and under any circumstances, of microbial or other biological agents or toxins, that is not consistent with prophylactic, protective or other peaceful purposes, is effectively a violation of Article I of the Convention.
وأكدت هذه الدول من جديد أيضاً أن استعمال الدول الأطراف للعوامل الجرثومية أو غيرها من العوامل البيولوجية أو التكسينات بأي شكل وفي أي ظرف يشكل انتهاكاً فعلياً للمادة الأولى من الاتفاقية إذا لم يكن ذلك الاستعمال مراعياً لمقاصد الحماية أو الوقاية أو غير ذلك من المقاصد السلمية.

The Conference considers the development and use of biological agents and toxins for hostile purposes under any pretext and in any form as a violation of Article I of the Convention.
4- ويعتبر المؤتمر استحداث واستعمال العوامل البيولوجية والتكسينات لأغراض عدائية بأية ذريعة وبأي شكل إخلالاً بأحكام المادة الأولى من الاتفاقية.

The Conference underlines that " hostile purposes " referred to in Article I of the Convention includes the use of biological agents and toxins in a military or covert operation against humans, animals and plants.
5- ويُبرِز المؤتمر أن " الأغراض العدائية " المشار إليها في المادة الأولى من الاتفاقية تشمل استعمال العوامل البيولوجية والتكسينات في عملية عسكرية أو مستترة تستهدف الإنسان والحيوان والنبات.

In June this year, China's National People's Congress ratified the amendment to article I of the Convention on Certain Conventional Weapons (CCW).
ففي حزيران/يونيه من هذا العام، صدق المؤتمر الشعبي الوطني الصيني على تعديل المادة الأولى من الاتفاقية المتعلقة بأسلحة تقليدية معينة.

7. The Conference welcomes statements made by States Parties, and newly acceding and ratifying States Parties, that they do not possess agents, toxins, weapons, equipment or means of delivery as prohibited by Article I of the Convention.
7- يرحب المؤتمر بالبيانات الصادرة عن الدول الأطراف والدول الأطراف التي انضمت أو صدقت مؤخراً على الاتفاقية بأنها لا تمتلك عوامل أو تكسينات أو أسلحة أو معدات أو وسائل إيصال مما هو محظور في المادة الأولى من الاتفاقية.

Welcoming the reaffirmation made in the Final Declaration of the Fourth Review Conference that under all circumstances the use of bacteriological (biological) and toxin weapons and their development, production and stockpiling are effectively prohibited under article I of the Convention,
وإذ ترحب بما ورد في الإعلان الختامي للمؤتمر الاستعراضي الرابع() من إعادة التأكيد على أنه من المحظور حظر فعليا في جميع الأحوال بموجب المادة الأولى من الاتفاقية حظر استخدام الأسلحة البكتريولوجية (البيولوجية) والسمية واستحداثها وإنتاجها وتكديسها،

The Conference emphasizes that the use of biological and toxin weapons, in any way and under any circumstances, is effectively a violation of Article I of the Convention and the Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or Other Gases, and of Bacteriological Methods of Warfare.
2- ويشدد المؤتمر على أن استعمال الأسلحة البيولوجية والتكسينية، بأية طريقة وفي أية ظروف، هو فعلياً إخلال بأحكام المادة الأولى من الاتفاقية ومن بروتوكول حظر الاستعمال الحربي للغازات الخانقة أو السامة أو ما شابهها وللوسائل البكتريولوجية.

The Conference emphasizes that " microbial or other biological agents, or toxins " referred to in Article I of the Convention include only the agents capable of being transformed to biological weapons against human, animals and plants.
6- ويشدد المؤتمر على أن " العوامل الجرثومية أو العوامل البيولوجية الأخرى " المشار إليها في المادة الأولى من الاتفاقية لا تشمل سوى العوامل التي يمكن تحويلها إلى أسلحة بيولوجية لاستخدامها ضد الإنسان والحيوان والنبات.
