وإذ يساورها القلق أيضاً إزاء التقارير الواردة عن حالات عرقلة محاولة الأفراد الاستفادة من الإجراءات المنشأة برعاية الأمم المتحدة لحماية حقوق الإنسان والحريات الأساسية،

States should refrain from referring unaccompanied and separated children into asylum procedures if their presence in the territory does not raise the question of international refugee protection needs. This is without prejudice to the obligation of States to refer unaccompanied or separated children to relevant procedures serving child protection, such as those foreseen under child welfare legislation.
وينبغي للدول أن تمتنع عن إحالة الأطفال غير المصحوبين والمنفصلين عن ذويهم إلى الهيئات المعنية بإجراءات طلب اللجوء إذا كان وجودهم في إقليم الدولة لا يثير مسألة احتياجات اللاجئين في مجال الحماية الدولية، وذلك مع عدم الإخلال بالتزام الدول بإحالة الأطفال غير المصحوبين أو المنفصلين عن ذويهم إلى الإجراءات ذات الصلة التي تقدم الحماية، على غرار الإجراءات المنشأة بموجب التشريعات المتعلقة برعاية الأطفال.

The Commission also expressed concern at reports about incidents where private individuals had been hampered in their efforts to avail themselves of procedures established under United Nations auspices for the protection of human rights and fundamental freedoms.

(c) Those who submit or have submitted communications under procedures established by human rights instruments;

OIP shall process applications for these materials in the interim 60-day period prior to the implementation of this paragraph under the procedures established pursuant to resolution 1409 (2002).

Moreover, like other non-aligned countries, Cuba rejects the unfounded accusations of non-compliance with international instruments related to weapons of mass destruction and reaffirms that States parties, in making such allegations, must use the procedures established in those instruments and must present the necessary evidence.

(b) Those who avail or have availed themselves of procedures established under United Nations auspices for the protection of human rights and fundamental freedoms and all those who have provided legal assistance to them for this purpose;

It is the responsibility of the judiciary to hear cases and matters within its jurisdiction by means of procedures established by law and to enforce or ensure the enforcement of its judgements.
