The word " automatically " used in the new EU Regulation may lead to problems of interpretation as the AAD requires that no investigation may be carried out without sufficient prior evidence of dumping and injury.
وقد تؤدي عبارة " تلقائياً " المستخدمة في لائحة الاتحاد اﻷوروبي الجديدة الى إثارة مشاكل تفسير نظراً الى أن الاتفاق المعني بممارسات مكافحة اﻹغراق يستلزم ألا يجرى أي تحقيق قبل أن تتوافر أدلة كافية عن اﻹغراق والضرر.

However, the new EU regulation (article 16 (4) (b)) only partially reproduces the contents (i.e. point (i)) of article 5.2 (b) of the ASG which may lead to different interpretation with regard to the other conditions regarding justification and equitable conditions of the ASG.

Furthermore, the new EU Regulation (article 11.6) provides that " where measures are repealed for individual exporters, but not for the country as a whole, such exporters shall remain subject to the proceedings and may, automatically, be reinvestigated in any subsequent review carried out for that country " .
وتنص لائحة الاتحاد اﻷوروبي الجديدة باﻹضافة الى ذلك )المادة ١١-٦( على أنه " عندما تلغى الاجراءات بالنسبة لمصدرين أفراد وليس للبلد ككل يظل هؤلاء المصدرين اﻷفراد، خاضعين للتدابير ويجوز أن يعاد التحقيق بصددهم تلقائياً في أي مراجعة لاحقة تجرى فيما يتصل بذلك البلد " .

It is clear from the AAD that an application for expiry review can only be filed by domestic industry who meet the standing requirements laid down by the AAD; the wording of the new EU Regulation may allow the submission of such applications by " Community producers " who may not meet the standing requirements.
