With reference to the report of the Secretary-General on the right of peoples to self-determination (A/59/376), which reported the advisory opinion of the International Court of Justice on the construction of the wall by Israel, his delegation called upon the General Assembly and the international community to give special attention to the violation of the right to self-determination resulting from foreign occupation and the use of mercenaries.

2. The new international humanitarian order should emphasize, in particular, the need for the universal application of the right to self-determination in the case of peoples living under foreign occupation or domination.
٢ - كما ينبغي للنظام اﻹنساني الدولي الجديد أن يؤكد، بوجه خاص، الحاجة إلى التطبيق الشامل لحق تقرير المصير في حالة الشعوب التي ترزح تحت الاحتلال اﻷجنبي أو السيطرة اﻷجنبية.

16. Turning to item 109, she noted that, despite the norms of international law, the principles enshrined in the Charter and numerous United Nations resolutions, many peoples continued to be denied the right to self-determination, because they lived under foreign occupation or were refugees.

40. While the concept of self—determination applies essentially to people under foreign occupation or alien domination, individuals have a continuing right to freely determine their political status and pursue their economic, social and cultural development.
٤٠- وفي حين أن مفهوم تقرير المصير ينطبق أساساً على الشعوب الواقعة تحت الاحتلال اﻷجنبي أو السيطرة اﻷجنبية، فان اﻷفراد لهم حق دائم في العمل بحرية على تقرير وضعهم السياسي والسعي إلى تحقيق تنميتهم الاقتصادية والاجتماعية والثقافية.
