The provisions of article 18 of this Law shall apply mutatis mutandis to the pre-selection proceedings, except to the extent that those provisions are derogated from in this paragraph:
وتسري على إجراءات الاختيار الأوَّلي أحكام المادة 18 من هذا القانون، مع ما يقتضيه اختلاف الحال من تغييرات، إلاَّ إذا نصّت هذه الفقرة على تحلّل جزئي من تلك الأحكام:

It was agreed that the wording of the article should not change but that the Guide should discuss the options in the text regarding the languages to be used in the pre-qualification, pre-selection and solicitation documents.
44- اتُّفق على عدم تغيير صيغة هذه المادة، على أن يشرح الدليل الخيارات الواردة في النص بشأن اللغات التي ستُستخدَم في وثائق التأهيل الأوَّلي ووثائق الاختيار الأوَّلي ووثائق الالتماس.

2. Deadlines for presenting applications to pre-qualify or for pre-selection or for presenting submissions shall be expressed as a specific date and time and shall allow sufficient time for suppliers or contractors to prepare and present their applications or submissions, taking into account the reasonable needs of the procuring entity.
2- يُعبَّر عن المواعيد النهائية لتقديم طلبات التأهُّل الأوَّلي أو الاختيار الأوَّلي أو تقديم العروض بتاريخ معين ووقت معين، ويجب أن تتيح تلك المواعيد للموَرِّدين أو المقاولين وقتاً كافياً لإعداد وتقديم طلباتهم أو عروضهم، على أن يؤخذ في الاعتبار ما للجهة المشترية من احتياجات معقولة.

5. Notice of any extension of the deadline shall be given promptly to each supplier or contractor to which the procuring entity provided the pre-qualification, pre-selection or solicitation documents.
5- يُسارَع إلى توجيه إشعار بأيِّ تمديد للموعد النهائي إلى كل مُورِّد أو مقاول زوَّدته الجهةُ المشترية بوثائق التأهيل الأوَّلي أو الاختيار الأوَّلي أو الالتماس.

(a) The procuring entity engages in pre-qualification proceedings in accordance with article 18 of this Law or in pre-selection proceedings in accordance with paragraph 3 of article 49 of this Law;
(أ) عندما تقوم الجهة المشترية بإجراءات التأهيل الأوَّلي وفقا للمادة 18 من هذا القانون أو إجراءات الاختيار الأوَّلي وفقا للفقرة 3 من المادة 49 من هذا القانون؛ أو

It was understood that any changes made to the solicitation, pre-qualification or pre-selection documents in accordance with article 14 would be material and therefore covered by paragraph 3 of article 15; the link between the provisions would be highlighted in the Guide.
46- وكان مفهوماً أنَّ أيَّ تغيير يُجرى على وثائق الالتماس أو وثائق التأهيل الأوَّلي أو وثائق الاختيار الأوَّلي وفقاً للمادة 14 سيكون تغييراً جوهرياً وبالتالي مشمولاً بالفقرة 3 من المادة 15؛ على أن يُوضّح وجه الارتباط بين أحكام المادتين في الدليل.

1. The manner, place and deadline for presenting applications to pre-qualify or for pre-selection shall be set out in the invitation to pre-qualify or for pre-selection and in the pre-qualification or pre-selection documents, as applicable.
1- تُحدَّد طريقةُ ومكان تقديم طلبات التأهُّل الأوَّلي أو الاختيار الأوَّلي والموعد النهائي لتقديمها في الدعوة إلى التأهُّل الأوَّلي أو إلى الاختيار الأوَّلي وفي وثائق التأهيل الأوَّلي أو الاختيار الأوَّلي، حسبما يكون مطبّقاً.

(b) The pre-selection documents shall set out the maximum number of pre-selected suppliers or contractors from which the proposals will be requested and the manner in which the selection of that number will be carried out.
(ب) يُحدَّد في وثائق الاختيار الأوَّلي العددُ الأقصى للمورِّدين أو المقاولين المختارين اختياراً أوَّليًّا الذين سوف تُطلب منهم الاقتراحات، والكيفية التي سوف يجري بها اختيار ذلك العدد.

(a) The procuring entity shall specify in the pre-selection documents that it will request proposals from only a limited number of pre-selected suppliers or contractors that best meet the qualification criteria specified in the pre-selection documents;
(أ) تنصُّ الجهةُ المشترية في وثائق الاختيار الأوَّلي على أنها لن تطلب اقتراحات إلاَّ من عدد محدود من المورِّدين أو المقاولين، المختارين اختياراً أوَّليًّا، الذين يفون على أحسن وجه بمعايير التأهُّل المحدّدة في وثائق الاختيار الأولي؛

(c) The procuring entity shall rate the suppliers or contractors that meet the criteria specified in the pre-selection documents according to the manner of rating that is set out in the invitation to pre-selection and the pre-selection documents;
(ج) ترتّب الجهة المشترية درجات المورِّدين أو المقاولين الذين يفون بمعايير التأهُّل المحدّدة في وثائق الاختيار الأوَّلي وفقاً لكيفية الترتيب المبيّنة في الدعوة إلى الاختيار الأوَّلي وفي وثائق الاختيار الأولي؛

(a) Applications for reconsideration of the terms of solicitation, pre-qualification or pre-selection or decisions or actions taken by the procuring entity in pre-qualification or pre-selection proceedings shall be submitted prior to the deadline for presenting submissions;
(أ) تُقدَّم طلباتُ إعادة النظر في شروط الالتماس أو التأهيل الأوَّلي أو الاختيار الأوَّلي أو القرارات أو التدابير التي اتخذتها الجهة المشترية في سياق إجراءات التأهيل الأوَّلي أو الاختيار الأولي، في موعد يسبق انقضاء الموعد النهائي لتقديم العروض؛

(a) Applications for review of the terms of solicitation, pre-qualification or pre-selection or of decisions or actions taken by the procuring entity in pre-qualification or pre-selection proceedings shall be submitted prior to the deadline for presenting submissions;
(أ) تُقدَّم طلباتُ مراجعة شروط الالتماس أو التأهيل الأوَّلي أو الاختيار الأوَّلي أو القرارات أو التدابير التي اتخذتها الجهة المشترية في سياق إجراءات التأهيل الأوَّلي أو الاختيار الأوَّلي في موعد يسبق الموعد النهائي لتقديم العروض؛

4. The procuring entity may, at its absolute discretion, prior to a deadline for presenting applications to pre-qualify or for pre-selection or for presenting submissions, extend the applicable deadline if it is not possible for one or more suppliers or contractors to present their applications or submissions by the deadline initially stipulated because of any circumstance beyond their control.
4- يجوز للجهة المشترية أن تبادر، حسب تقديرها المُطلَق، وقبل الموعد النهائي لتقديم طلبات التأهُّل الأوَّلي أو الاختيار الأوَّلي أو تقديم العروض، إلى تمديد ذلك الموعد النهائي المطبَّق إذا تعذّر على واحد أو أكثر من الموَرِّدين أو المقاولين أن يقدِّموا طلباتهم أو عُروضَهم قبل حلول ذلك الموعد النهائي المنصوص عليه في البداية، وذلك بسبب أيِّ ظروف خارجة عن نطاق سيطرتهم.

In pre-qualification, all pre-qualified suppliers or contractors may end up presenting submissions. In the case of preselection, the number of pre-qualified suppliers or contractors that will be permitted to present submissions is expressly limited at the outset of the procurement proceedings, and the maximum number of participants is made known in the invitation to preselection.
ففي حالة التأهيل الأوَّلي، قد يعمد جميع المورِّدين أو المقاولين المؤهّلين تأهيلا أوليا إلى تقديم عروضهم في نهاية المطاف.أمَّا في حالة الاختيار الأوَّلي، فإنَّ عدد المورِّدين أو المقاولين المؤهّلين تأهيلا أوليا الذين سيُسمح لهم بتقديم عروض يكون محدّدا تحديدا صريحا في بداية إجراءات الاشتراء، وتضمَّن الدعوة إلى الاختيار الأوَّلي إعلان العدد الأقصى من المشاركين.
