١٩٩٤/٣٥ - الحق في الاسترداد والتعويض واعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية

The international reports submitted to the Security Council on the human rights situation in the Republic of Bosnia and Herzegovina have shown persistent and gross violations of human rights as a result of continued aggression against its Muslim people.
أظهرت التقارير الدولية التي قدمت إلى مجلس اﻷمــــن عـن حالة حقوق الانسان في جمهورية البوسنة والهرسك، استمرار الانتهاكات الجسيمة لحقوق الانسان نتيجة العدوان المستمر على هذا الشعب المسلم.

1. Basic principles and guidelines on the right to reparation for victims of gross violations of human rights and humanitarian law.
١- المبادئ اﻷساسية والخطوط التوجيهية بشأن الحق في الجبر لضحايا الانتهاكات الجسيمة لحقوق الانسان والقانون الانساني.

Considering that the question of restitution, compensation and rehabilitation of victims of grave violations of human rights and fundamental freedoms has received insufficient attention and should continue to be addressed in a more systematic and thorough way at the national and international levels,
وإذ ترى أن مسألة الحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية لم تحظ بالاهتمام الكافي وأنه ينبغي مواصلة معالجتها بمزيد من المنهجية والشمول على الصعيدين الوطني والدولي،

1. Calls upon the international community to give increased attention to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms;
١- تدعو المجتمع الدولي إلى إيلاء اهتمام متزايد للحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية؛

That Declaration welcomed the convening of emergency sessions of the Commission on Human Rights as a positive initiative and recommended that consideration be given by the relevant organs of the United Nations system to other ways of responding to serious violations of human rights.
ورحب ذلك اﻹعلان بعقد دورات طارئة للجنة حقوق الانسان بوصفه مبادرة إيجابية وأوصى بأن تنظر اﻷجهزة المختصة في منظومة اﻷمم المتحدة في أساليب أخرى للرد على الانتهاكات الجسيمة لحقوق الانسان.

They expressed their conviction that all perpetrators of massive violations of human rights must be brought to justice.
وأعربتا عن اقتناعهما بأن جميع مرتكبي الانتهاكات الجسيمة لحقوق الانسان يجب أن يقدموا إلى العدالة.

540. The Committee regretted the absence of a dialogue between the Government and the leaders of the Albanians in Kosovo aimed at reducing tension and helping to prevent further massive human rights violations in the region.
٤٠٥ - وأعربت اللجنة عن أسفها لعدم قيام حوار بين الحكومة وزعماء اﻷلبانيين في كوسوفو يهدف الى الحد من التوتر والمساعدة على منع وقوع مزيد من الانتهاكات الجسيمة لحقوق الانسان في المنطقة.

It should be noted that a new title was proposed to reflect the contents of the revised document: Basic principles and guidelines on the right to reparation for victims of gross violations of human rights and humanitarian law.
وتجدر الاشارة الى اقتراح عنوان جديد يقصد به التعبير عن مضمون الوثيقة المنقحة: المبادئ اﻷساسية والخطوط التوجيهية بشأن حق ضحايا الانتهاكات الجسيمة لحقوق الانسان والقانون الانساني في الجبر.

19. Mr. Yokota considered that the notion of gross violations of human rights should be included in principle 6.
٩١- ورأى السيد يوكوتا أنه ينبغي إدراج مفهوم الانتهاكات الجسيمة لحقوق الانسان في المبدأ ٦.

For more effective implementation of the principles of human rights we feel it is imperative to establish the post of high commissioner for human rights and a permanent international criminal court where cases of gross violations of human rights and other crimes against humanity are submitted and prosecuted.
ومن أجل التنفيذ اﻷكثر فعالية لمبادئ حقوق الانسان، نرى أنه من المحتم إنشاء منصب المفوض السامي لحقوق الانسان، وإقامة محكمة جنائية دولية دائمة تقدم إليها قضايا الانتهاكات الجسيمة لحقوق الانسان وغيرها من الجرائم المرتكبة ضد الانسانية.

14. In the light of new developments in international law, it has become increasingly difficult for perpetrators of gross violations of human rights to escape liability simply by claiming to be a non-State actor.
٤١- وفي ضوء التطورات الجديدة في القانون الدولي، تتزايد باطراد صعوبة إفلات مرتكبي الانتهاكات الجسيمة لحقوق الانسان من المسؤولية لمجرﱠد ادﱢعاء أنهم فاعلون غير حكوميين.

24. The second sentence of clause 9 states that “civil claims” relating to reparations for gross violations of human rights and international humanitarian law shall not be subject to statutes of limitations.
٢٤- وتنص الجملة الثانية من البند ٩ على أن المطالبات المدنية المتعلقة بالتعويضات عن الانتهاكات الجسيمة لحقوق الانسان والقانون الانساني الدولي لا تخضع ﻷحكام التقادم.

Considering that the question of restitution, compensation and rehabilitation for victims of gross violations of human rights has received insufficient attention and should be addressed more consistently and more thoroughly at international and national levels,
واذ ترى أن مسألة الحق في الاسترداد والتعويض واعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق الانسان لم تحظ بعد بالاهتمام الكافي وأنه ينبغي معالجتها بمزيد من الاتساق والشمول على الصعيدين الدولي والوطني ،

Reaffirming that, pursuant to internationally proclaimed human rights and humanitarian law principles, victims of gross violations of human rights should receive, in appropriate cases, restitution, compensation and rehabilitation,
واذ تؤكد من جديد أنه وفقا لمبادئ حقوق الانسان والقانون الانساني المعلنة دوليا ، ينبغي أن يحصل ضحايا الانتهاكات الجسيمة لحقوق الانسان على الحق في الاسترداد والتعويض واعادة التأهيل في الحالات المناسبة ،

3. Expresses the hope that priority attention will be given to the question of restitution, compensation and rehabilitation for victims of gross violations of human rights and regards the proposed basic principles and guidelines contained in the study of the Special Rapporteur as a useful basis for this purpose;
٣- تعرب عن اﻷمل في ايلاء الاهتمام على سبيل اﻷولوية لمسألة الحق في الاسترداد والتعويض واعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية ، وترى في المبادئ اﻷساسية والخطوط التوجيهية المقترحة في دراسة المقرر الخاص أساسا نافعا لهذا الغرض ؛

Recalling also its resolution 1995/34 of 3 March 1995 in which it requested States to provide information to the Secretary-General about legislation already adopted, as well as that in the process of being adopted, relating to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms,
وإذ تشير أيضاً الى قرارها ٥٩٩١/٤٣ المؤرخ في ٣ آذار/مارس ٥٩٩١، الذي رجت فيه من الدول موافاة اﻷمين العام بالمعلومات بشأن التشريعات المعتمدة لديها فعلاً أو التي تجري عملية اعتمادها في صدد الحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية،

4. Requests States that have not yet done so to provide information to the Secretary-General on the legislation already adopted, as well as that in the process of being adopted, relating to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms;
٤- ترجو من الدول التي لم تقم بعد بموافاة اﻷمين العام بمعلومات عن التشريعات التي اعتمدتها فعلاً أو التي هي بصدد اعتمادها فيما يتصل بالحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية أن تفعل ذلك؛

1. Apart from the Constitution of the Republic of Trinidad and Tobago (chap. I, part I, sects. 4 and 5), there is no other legislation adopted or in the process of being adopted that relates to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms.
١- بخلاف دستور جمهورية ترينيداد وتوباغو )الفصل اﻷول، الباب اﻷول، المادتان ٤ و٥(، لا يوجد أي قانون آخر صادر أو قيد الصدور يتعلق بالاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية.

21. Recognizing that serious violations of human rights are a cause of population movements, UNHCR has, with the encouragement of the Executive Committee and the United Nations General Assembly, sought to strengthen its cooperation with the human rights bodies of the United Nations.
١٢- وتسليما بأن الانتهاكات الجسيمة لحقوق الانسان تتسبب في حركات السكان، سعت المفوضية، بتشجيع من اللجنة التنفيذية والجمعية العامة لﻷمم المتحدة، إلى توطيد تعاونها مع هيئات حقوق الانسان في اﻷمم المتحدة.

21. Recognizing that serious violations of human rights are a cause of population movements, UNHCR has, with the encouragement of the Executive Committee and the General Assembly, sought to strengthen its cooperation with the human rights bodies of the United Nations.
١٢ - وتسليما بأن الانتهاكات الجسيمة لحقوق الانسان تتسبب في حركات السكان، سعت المفوضية، بتشجيع من اللجنة التنفيذية والجمعية العامة، إلى توطيد تعاونها مع هيئات حقوق الانسان في اﻷمم المتحدة.

210. The representative described the terrible situation afflicting the country owing to the aggression of secessionist and external forces, whereby the Government was not in control of all its territory and was unable to halt massive violations of human rights in these areas.
٢١٠ - ووصف الممثل الحالة المريعة التي تحيق بالبلد من جراء عدوان القوى الانفصالية والخارجية، مما يجعل الحكومة غير مسيطرة على كامل إقليمها وغير قادرة على ايقاف الانتهاكات الجسيمة لحقوق الانسان في تلك المناطق.

(g) To express its solidarity with the former Special Rapporteur of the Commission on Human Rights, Mr. Tadeusz Mazowiecki, agreeing with him that the response of the international community has been slow and ineffectual in reacting to the massive human rights violations in Bosnia and Herzegovina;
)ز( أن تعرب عن تضامنها مع المقرر الخاص السابق للجنة حقوق الانسان، السيد تادوز مازوفيكي، واتفاقها معه، على أن استجابة المجتمع الدولي كانت بطيئة وعقيمة في معرض رد الفعل على الانتهاكات الجسيمة لحقوق الانسان في البوسنة والهرسك؛
