6-3 وفيما يتعلق باستنفاد سبل الانتصاف المحلية، تحيط اللجنة علماً بإدعاء الدولة الطرف عدم استنفاد هذه السبل لأن الانتهاك المدعى حدوثه والذي تنظر فيه اللجنة حالياً لم يعرض على المحكمة الدستورية التي يدعى أنها عدّلت سوابقها القضائية في أحكامها الصادرة خلال الفترة 2002-2004.
