4.1 The State party indicates that the author submitted his communication more than two and a half years after the Supreme Court judgement.

On 23 September 2004, the Central Electoral Commission dismissed the appeal by upholding the finding of the District Electoral Commission that the author had provided false information about his place of work.

It further noted that the author has submitted contradictory information about the times he had spent in detention and about the cause of the marks on his body.
