6.2 The Committee notes that the State party has raised no objections to the admissibility of the communication and has confirmed that the author has exhausted domestic remedies.

6.4 The Committee observes that, with the dismissal by the Judicial Committee of the Privy Council in October 1992 of the author's petition for special leave to appeal, the author has exhausted domestic remedies for purposes of the Optional Protocol.

6.5 Noting that the author argued his domestic appeal on the basis of an alleged violation of his right to be heard by an impartial and independent tribunal and on an alleged violation of his right to equal access to information, the Committee considers that the author has exhausted domestic remedies in respect of these remaining claims.
6-5 واللجنة إذ تلاحظ أن صاحب البلاغ يستند في التماسه المحلي إلى انتهاكٍ مزعوم لحقه في أن تستمع إليه محكمة نزيهة ومستقلة وفي أن يحصل كغيره على المعلومات، ترى أن صاحب البلاغ قد استنفد سبل الانتصاف المحلية فيما يتعلق بهذه الادعاءات المتبقية.

Accordingly the Committee considers that the author has exhausted domestic remedies in respect of this claim, and that it is not precluded from considering this part of the communication pursuant to article 5, paragraph 2 (b), of the Optional Protocol.

10.2 The Committee has ascertained, in accordance with article 5, paragraphs (a) and (b), of the Optional Protocol, that the same matter is not being examined under another international procedure of investigation or settlement, and that the author has exhausted domestic remedies, as conceded by the State party.

Noting that the author has failed to substantiate this allegation under article 14, paragraph 3 (e) for the purpose of admissibility, the Committee finds that it may still raise issues under article 14 3 (b) of the Covenant, and, notes that the author has exhausted domestic remedies on this count.
