198. The view was expressed that the on-site investigations envisaged under article 26, paragraph 2 (c), should be considered as a kind of assistance to be provided by States in response to an appropriate request from the court.
١٩٨ - وأعرب عن رأي ذهب الى أن التحقيقات في الموقع المتوخاه في المادة٢٦ ، الفقرة ٢ )ج(، يجب أن تعتبر من قبيل المساعدة الواجب أن تقدمها الدول استجابة لطلب مناسب من المحكمة.

32. The Commission is requested to reconsider the wording of paragraphs 2 and 3, which may be read as suggesting that the prosecutor may summon suspects, victims and witnesses, collect evidence and conduct on-site investigations directly on the territory of States parties and others, without seeking the cooperation of the State concerned.
٣٢ - ويطلب من اللجنة أن تنظر في صياغة الفقرتين ٢ و ٣، التي قد يفهم منها أنه يجوز للمدعي العام أن يأمر بحضور المشتبه فيهم والمجني عليهم والشهود وجمع اﻷدلة وإجراء التحقيقات في الموقع مباشرة في أراضي الدول اﻷطراف وغيرها من الدول، دون التماس تعاون الدول المعنية.

33. It is therefore suggested that articles 30 (2) and 30 (e) be modified so as to provide that the prosecutor shall have power to request: (a) the presence of suspects, victims and witnesses for questioning; (b) the disclosure and production of evidence, including any document or exhibits relating to the complaint; and (c) on-site investigations.
٣٣ - ويقترح بالتالي تعديل الفقرتين )٢( و )٣( من المادة ٣٠ لكي تنصا على أن للمدعي العام سلطة طلب: )أ( حضور المشتبه فيهم والمجني عليهم والشهود لاستجوابهم؛ )ب( والكشف عن اﻷدلة وتقديمها، بما في ذلك أي مستندات كتابية أو مستندات مبرزة ذات صلة بالشكوى؛ و )ج( إجراء التحقيقات في الموقع.

Assuming that the draft provision in question becomes part of the optional protocol and enters into force as such, the Committee could only exercise its extended functions (i.e. on-site investigations) vis-à-vis those States parties to the Convention which are States parties to the optional protocol.
وبافتراض أن مشروع الحكم المعني سيصبح جزءاً من البروتوكول الاختياري ويدخل حيز النفاذ بهذه الصفة، فإنه لن يكون بوسع اللجنة أن تمارس مهامها الموسع نطاقها )أي التحقيقات في الموقع( إلا تجاه تلك الدول اﻷطراف في الاتفاقية التي تكون دولاً أطرافاً في البروتوكول الاختياري.
