49. The [appellate body]'s judgment may provide for the conclusion of multiple appeals in relation to the same request for registration or issuance.

This official shall not support the work of the Executive Board on requests for registration or issuance or on the substance of any appeal in relation to a request for registration or issuance.

9. For an appeal based on the grounds that the reconsidered ruling of the Executive Board is inconsistent with the previous judgment of the [appellate body] on the same request for registration or issuance, all of the following elements must be present and argued:
9- ويجب في الطعن المستند إلى عدم انسجام قرار المجلس التنفيذي المعاد فيه النظر مع قرار سابق اتخذته [هيئة الطعون] بشأن نفس طلب التسجيل أو الإصدار أن يعرض بالحجة جميع العناصر التالية:

(b) That the reconsidered ruling, if consistent with the judgment of the [appellate body], would not have rejected or required an alteration to the request for registration or issuance.
(ب) أن القرار المعاد فيه النظر ما كان ليقضي برفض طلب التسجيل أو الإصدار لو كان منسجماً مع قرار [هيئة الطعون].

(b) By remanding the request for registration or issuance to the Executive Board for further consideration.
(ب) إرجاع طلب التسجيل أو الإصدار إلى المجلس التنفيذي لإجراء مزيد من البحث.

51. After receiving notice of the [appellate body]'s remand, the Executive Board shall reconsider and decide on the request for registration or issuance.
51- بعد تلقي المجلس التنفيذي إخطار [هيئة الطعون] فيما يتعلق بإرجاع المسألة إليه، يعيد المجلس التنفيذي النظر في طلب التسجيل أو الإصدار ويبت فيه.

(c) That the fact, or set of facts, if corrected and considered, would not have resulted in the ruling that rejected or required an alteration to the request for registration or issuance.
(ج) أن واقعة أو مجموعة من الوقائع ما كانت لتؤدي إلى قرار رفض طلب التسجيل أو الإصدار أو اشتراط تغييرهما لو صححت أو جرى تناولها.

(b) That the CDM rules and requirements, if interpreted or applied differently, would not have resulted in the ruling that rejected or required an alteration to the request for registration or issuance.
(ب) أن قواعد آلية التنمية النظيفة واشتراطاتها ما كانت لتؤدي إلى قرار رفض أو تعديل طلب التسجيل أو الإصدار لو فسرت أو طبقت على نحو مختلف.

21. At any time during its consideration of the appeal, the [appellate body] may request the DOE that validated or verified the request for registration or issuance under appeal to clarify any information contained in its validation or verification report or submitted to the Executive Board in response to a request for review.
21- يجوز ﻟ [هيئة الطعون] في أي مرحلة من مراحل النظر في الطعن أن تطلب إلى الكيان التشغيلي المعيّن الذي صدق على طلب التسجيل أو الإصدار موضوع الطعن أن يوضح أي معلومات ترد في تقرير التصديق أو التحقق أو أي معلومات قدمت إلى المجلس التنفيذي كرد على طلب استعراض.

(b) Reject the request for registration or issuance.

In order to improve the transparency of its decision-making, the Board requested the secretariat to begin to publish information notes to provide appropriate background and explanations of Executive Board decisions on requests for registration or issuance where the Board agreed not to register the project or not to approve the issuance of CERs.
117- وليحسن المجلس الشفافية في اتخاذ قراراته، فقد طلب إلى الأمانة أن تبدأ نشر مذكرات إعلامية لتقديم المعلومات الأساسية والإيضاحات المتعلقة بقرارات المجلس التنفيذي بشأن طلبات التسجيل أو الإصدار عندما يكون المجلس قد قرر عدم تسجيل المشروع أو عدم إقرار إصدار وحدات خفض الانبعاثات المعتمد.
