However, the legal status of the National Charter remains ambiguous since it is regarded as a conceptual document the enforceability of which has not yet been tested in the courts. Hence, there is a need for a judicial ruling concerning the status of the Charter in Jordanian legislation, as well as confirmation of its legally binding nature, in order to put our minds at rest with regard to equality between the sexes.
إلا أن مكانة الميثاق الوطني من الناحية القانونية لا تزال مبهمة حيث يعتبر الميثاق وثيقة فكرية لولا تتوفر سوابق قضائية حتى الآن عن مكانة الميثاق، الأمر الذي يتطلب إقراراً قضائياً عن مكانة الميثاق في التشريعات الأردنية وإعطائه حق الإلزامية قبل أن نشعر بارتياح بالنسبة للمساواة بين الجنسين.

41. Jordanian legislation recognizes the right of the child to express his or her opinion orally, in writing or through the available information media, including children's radio and television programmes and the children's sections of the official daily newspapers.
41- لقد تضمنت التشريعات الأردنية حق الطفل في التعبير عن رأيه بالقول والكتابة بوسائل الإعلام المتاحة له من خلال البرامج التلفزيونية والاذاعية المخصصة للأطفال وأيضاً من خلال الملاحق الخاصة للأطفال في الصحف اليومية الرسمية.

130. A new Directorate, known as the International Relations Directorate, has been created within the Ministry of Justice. It is mandated to attain a set of objectives, one of which is to ensure that Jordanian legislation conforms to the country's commitments arising from international instruments to which it is a party, including instruments relating to the rights of the child.
130- استحدثت مديرية جديدة في وزارة العدل هي مديرية العلاقات الدولية التي تسعى إلى تحقيق مجموعة أهداف منها التأكد من انسجام التشريعات الأردنية مع التزامات الأردن الناشئة عن الاتفاقيات الدولية التي تصادق عليها، ويشمل ذلك الاتفاقيات المتعلقة بحماية حقوق الطفل.

77. The Government of Jordan reconfirms what has been mentioned in paragraph 50 of its national report that the Jordanian legislation guarantees the right of any person who believes he was tortured to bring his case to court and lodge a complaint against the person or party he claims to have committed the torture. A person also has the right to take civil action to demand compensation by virtue of article 256 of the Civil Law.
77- تعيد الحكومة الأردنية التأكيد على ما ورد في الفقرة 50 من تقريرها الوطني، حيث تضمن التشريعات الأردنية حق أي شخص يعتقد أنه تعرض للتعذيب باللجوء إلى القضاء وتقديم شكوى ضد الشخص أو الجهة التي يدعي عليها، وله الحق بإقامة دعوى مدنية للمطالبة بالتعويض بموجب المادة 256 من القانون المدني.

4. Jordanian legislation (article 100 of the amended Criminal Proceedings Law No. 16 of 2001) has determined the period of detention of an accused person at police stations to be 24 hours, after which the accused shall be referred to the concerned public prosecutor as the legal authority in charge of the investigation.
4- لقد حددت التشريعات الأردنية (المادة 100 من قانون أصول المحاكمات الجزائية المعدل رقم 16 لسنة 2001) مدة الاحتفاظ بالمشتكي عليه لدى مراكز الشرطة ب24 ساعة تتم بعدها إحالته إلى المدعي العام المختص باعتباره الجهة القضائية المكلفة بإجراء التحقيق.

(a) The child's right to life as enshrined in Jordanian law
(أ) حق الطفل في الحياة كما ورد في التشريعات الأردنية

Jordanian law on the administration of juvenile justice is consistent with the Convention on the Rights of the Child, inasmuch as all individuals are deemed to be equal before the law, with no discrimination on the basis of sex, colour, ethnic origin or religion.
- تنسجم التشريعات الأردنية الخاصة بقضاء الأحداث مع اتفاقية حقوق الطفل من حيث التعامل مع الأطفال الأحداث بشكل متساو دون التمييز على أساس الجنس أو اللون أو العرق أو الدين.

308. Jordanian law guarantees juveniles' right to survival and development to the maximum extent possible. Juveniles may not be sentenced to death or to hard labour.
308- تكفل التشريعات الأردنية حق الحدث في البقاء والنمو إلى أقصى حد ممكن حيث يحظر إيقاع عقوبة الإعدام على الأحداث، كما تحظر عقوبة الأشغال الشاقة على الأحداث.

34. Jordan acceded to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment in 1991 and the Convention has become part of Jordanian law.
34- انضم الأردن عام 1991 إلى اتفاقية مناهضة التعذيب وغيرها من المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة وقــد أضحـت هـذه الاتفاقية جزءاً من التشريعات الأردنية.

The conclusion that Jordanian laws do not apply to perpetrators of ill-treatment is a false one; many members of the police and security services have been tried for abuse of authority, as we shall show below. In addition, the General Security Directorate is investigating a number of the cases of alleged torture mentioned in the report and the perpetrators of these acts will be punished, if found guilty.
إن القول بأن التشريعات الأردنية لم تُطبَّق بحق مرتكبي جرائم إساءة المعاملة لهو استنتاج غير صحيح، حيث حوكم العديد من أفراد الشرطة والأجهزة الأمنية بسبب إساءة استخدامهم لسلطتهم، كما سنبين لاحقاً، إضافة إلى أن مديرية الأمن العام تجري تحقيقاً في عدد من القضايا الواردة في التقرير والتي يدَّعي أصحابها بأنهم تعرضوا للتعذيب.
