The reason for this delay has been that the Finnish legislation in respect of land ownership rights has not been considered to be in harmony with the provisions of the Convention.

٩١ - ولم تصادق فنلندا بعد على اتفاقية منظمة العمل الدولية رقم ٩٦١ بخصوص السكان اﻷصليين ﻷنه ليس واضحا ما إذا كان التشريع الفنلندي المتعلق بحق شعب سامي في ملكية اﻷرض، منسجما مع أحكام الاتفاقية.

The European Committee of Social Rights has in fact already concluded that the Finnish legislation is in conflict with Article 6, paragraph 4, of the European Social Charter, recalling that restrictions which meant that in practice civil servants could only take collective action in order to obtain a collective agreement were not in conformity with this provision of the Charter.

75. The Committee expresses its concern that article 4 of the Convention is not fully complied with, since there is no provision in the Finnish legislation prohibiting and punishing organizations which promote and incite racial discrimination.

ولم توقع حكومة فنلندا بعد على اتفاقية منظمة العمل الدولية رقم 169 بشأن الشعوب الأصلية والقبلية في البلدان المستقلة، لأن التشريع الفنلندي لا يعترف تماما، ضمن جملة أمور بحقوق ملكية الأراضي التي يشغلها الصاميون تقليديا وامتلاكها.

٢٢١- ولم تصدق فنلندا بعد على اتفاقية منظمة العمل الدلولية رقم ٩٦١ بشأن الشعوب اﻷصلية والقبلية في البلدان المستقلة ﻷنه ليس من الواضح ما إذا كان التشريع الفنلندي بشأن حقوق السامي في ملكية اﻷرض يتمشى مع أحكام الاتفاقية.

In this regard, the Government of Finland is currently considering whether it is possible and desirable in the light of the present Finnish legislation to accede to the International Convention against the Recruitment, Use, Financing and Training of Mercenaries, adopted by the General Assembly on 4 December 1989.”

The observer for Finland said that the new legislation on Sami cultural autonomy did not include provisions pertaining to land rights, and that the current Finnish legislation did not acknowledge Sami land rights.
١٦- وقال المراقب عن فنلندا إن التشريع الجديد بشأن الاستقلال الثقافي الصامي لا يشتمل على أحكام خاصة بالحقوق المتعلقة باﻷراضي، وإن التشريع الفنلندي النافذ حالياً لا يعترف بحقوق الصاميين المتعلقة باﻷراضي.

11. Even though the idea of guaranteeing the Saami a seat in the Finnish Parliament has been rejected so far, an obligation for the Government and Parliament to hear the Saami in all matters of special concern has been introduced into Finnish legislation.
