In response, it was observed that the question of treaty-based investor-State disputes was to be discussed as a matter of priority after completion of the revision of the Rules, and that the question of preliminary orders in the context of treaty-based investor-State disputes could be further considered at that stage.
وردّا على ذلك، لوحظ أن مسألة النـزاعات التعاهدية بين المستثمرين والدول من المقرر أن تُناقش كموضوع ذي أولوية بعد الانتهاء من تنقيح القواعد وأن مسألة الأوامر الأولية في سياق النـزاعات التعاهدية بين المستثمرين والدول يمكن مواصلة بحثها في تلك المرحلة.

It was suggested that conciliation/mediation with respect to the settlement of treaty-based investor-State disputes should be considered as a topic for future work by the Working Group.

104. Concern was expressed that introducing paragraph (5) in the Rules could undermine their acceptability, particularly by States in the context of treaty-based investor-State dispute resolution.
104- وأُبديت شواغل بشأن إدخال الفقرة (5) في القواعد لأن هذا يمكن أن يجعلها غير مقبولة، ولا سيما لدى الدول في سياق تسوية النـزاعات التعاهدية بين المستثمرين والدول.

The Working Group was reminded that the mandate given to the Working Group by the Commission at its forty-first session was limited to the question of transparency in treaty-based investor-State disputes (see paragraph 8 above).
وذُكِّر الفريق العامل بأن الولاية التي أسندتها إليه اللجنة في دورتها الحادية والأربعين مقصورة على مسألة الشفافية في النـزاعات التعاهدية بين المستثمرين والدول (انظر الفقرة 8 أعلاه).
