وقيل أيضاً إنَّ الإشارة إلى التفرُّد أمر ضروري من أجل ضمان التميُّز وتفادي تعدُّد المطالبات، وإنَّ مفهوم السيطرة لا يمكنه وحده أن يحقِّق التميُّز بالنظر إلى الفرق بين السيطرة في حدِّ ذاتها والشيء موضوع السيطرة، أيْ السجل الإلكتروني القابل للتحويل.

It was added that specific reference to exclusive control might avoid the need to refer to the notion of " uniqueness " , which posed legal and technical challenges.
