1. Elimination of discrimination against women in all matters relating to marriage and family relations
1 - القضاء على التمييز ضد المرأة في جميع المسائل المتعلقة بالزواج والعلاقات الأسرية

As a consequence, article 2 of the Convention, which prohibits discrimination between women and men, and article 16, paragraph 1, which deals with discrimination against women in all matters relating to marriage and family relations, cannot be invoked and are not applicable.

201. In line with article 16 of the Convention, the judicial branch has taken measures to eliminate discrimination against women in all matters concerning family relations. Accordingly, plans have been formulated for a pilot project in the area of strengthening the system of justice with regard to the family and reforming laws that discriminate against women.
201- وفي مجال العلاقات العائلية، الواردة في المادة 16 من الاتفاقية، اتخذت السلطة القضائية تدابير للقضاء على التمييز ضد المرأة في جميع المسائل المتصلة بالعلاقات العائلية ولذلك يجري النظر في مشروع نموذجي لتعزيز نظام العدالة في مجال الأسرة وإصلاح القوانين التمييزية ضد المرأة.

9.3 With regard to article 16, paragraph 1, the authors contend that the State party has not taken all appropriate measures to eliminate discrimination against women in all matters relating to marriage and family relations, because of the impossibility for a woman or a man to have her/his mother's name established in her/his person's civil status.
9-3 أما بخصوص الفقرة 1 من المادة 16، فتقول مقدمتا البلاغ إن الدولة الطرف لم تتخذ جميع التدابير المناسبة للقضاء على التمييز ضد المرأة في جميع المسائل المتعلقة بالزواج والعلاقات الأسرية، بسبب استحالة تثبيت اسم الأم في الحالة المدنية للمرأة أو الرجل.

11.5 We are of the view, having carefully examined the substance of the arguments of both parties, that the authors' core assertion is that the State party did not take appropriate measures to eliminate discrimination against women in all matters relating to marriage and family relations.
11-5 وبعد النظر بتمعن في فحوى حجج كل من الطرفين نرى أن مقدمات البلاغ أكدن بصفة رئيسية أن الدولة الطرف لم تتخذ التدابير الواجبة للقضاء على التمييز ضد المرأة في جميع المسائل المتعلقة بالزواج والعلاقات الأسرية.

9. Recalling its previous recommendation (CEDAW/C/ISR/CO/3, para. 26), the Committee urges the State party to consider withdrawing its reservations to article 7 (b) and especially to article 16 of the Convention in order to eliminate discrimination against women in all matters relating to marriage and family relations in line with articles 2 and 16 of the Convention.
9- تُذكِّر اللجنة بتوصيتها السابقة (CEDAW/C/ISR/CO/3، الفقرة 26)، وتحث الدولة الطرف على النظر في سحب تحفظاتها على المادة 7(ب)، وبخاصة تحفُّظها على المادة 16 من الاتفاقية، من أجل القضاء على التمييز ضد المرأة في جميع المسائل المتصلة بالزواج والعلاقات الأسرية وفقاً للمادتين 2 و16 من الاتفاقية.
