26. Although the Covenant does not expressly require the adoption of affirmative action measures, the Committee has stated that the principle of equality may require States parties to take such measures in order to diminish or eliminate conditions, which cause or help to perpetuate discrimination prohibited by the Covenant.

The United Nations conventions on these issues, dated 25 February 1991, 17 March 1992 and 21 May 1997, demand that all States " ensure that transboundary waters are used in a reasonable and equitable way, taking into particular account their transboundary character, in the case of activities which cause or are likely to cause transboundary impact " .

HRC has indicated that " the principle of equality sometimes requires States parties to take affirmative action in order to diminish or eliminate conditions which cause or help to perpetuate discrimination " . (HRC general comment No. 18, para. 10).
