36. With respect to guideline 3.2.1, while it was generally felt that allowing treaty monitoring bodies to assess the permissibility of reservations formulated by a State could ensure certainty as to the reservation's validity and permissibility and minimize the likelihood that it would be contested in the future, the extent of the legal effect of the treaty monitoring body's conclusions should be explained.
36 - وقالت فيما يخص المبدأ التوجيهي 3-2-1 إنه، وبرغم وجود شعور عام بأن السماح لهيئات رصد المعاهدات بتقييم جواز التحفظات التي تصوغها دولة قد يكفل اليقين بشأن صحة التحفظ وجوازه، ويقلل من احتمال الطعن فيه مستقبلا، إلا أنه ينبغي توضيح مدى الأثر القانوني للاستنتاجات التي تتوصل إليها هيئة رصد المعاهدة.

(9) Moreover, there can be no doubt that communications relating to reservations -- especially those concerning the actual text of reservations formulated by a State or an international organization -- are communications " relating to the treaty " within the meaning of article 78, paragraph 1 (e), referred to above.

(51) Paragraph 4 of guideline 4.5.3 must be read in the light of guideline 3.2.1, according to which a treaty monitoring body may assess the permissibility of reservations formulated by a State or an international organization, it being understood that such an assessment " has no greater legal effect than that of the act which contains it " .
51) وينبغي أن تقرأ الفقرة 4 من المبدأ التوجيهي 4-5-3 في ضوء المبدأ التوجيهي 3-2-1، الذي ينص على أنه يجوز لهيئة رصد معاهدة أن تقيّم جواز التحفظات التي تصوغها دولة أو منظمة دولية، على " ألا يتجاوز الأثر القانوني للتقييم الأثر القانوني المترتب على الفعل الذي يكون موضعا للتقييم " .
