In the discharge of its mandate, the Working Group refers to the relevant international standards set forth in the Universal Declaration of Human Rights and the relevant international instruments accepted by the States concerned, in particular the International Covenant on Civil and Political Rights, as well as, when appropriate, the following standards:
ويشير الفريق العامل لدى تنفيذ ولايته إلى المعايير الدولية ذات الصلة المبينة في اﻹعلان العالمي لحقوق اﻹنسان والصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، وبالتحديد العهد الدولي الخاص بالحقوق المدنية والسياسية وكذلك إلى المعايير التالية عند الاقتضاء:

When the complete or partial nonobservance of the international standards relating to a fair trial set forth in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned is of such gravity as to confer on the deprivation of liberty, of whatever kind, an arbitrary character (category III).
' 3 ' عندما يكون عدم الامتثال، الكلي أو الجزئي، للمعايير الدولية المتصلة بالحق في محاكمة عادلة، وهي المعايير المحددة في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يُضفي على الحرمان من الحرية، أياً كان نوعه، طابعاً تعسفياً (الفئة الثالثة).

Bearing in mind that, in accordance with resolution 1991/42, the task of the Working Group on Arbitrary Detention is to investigate cases of detention imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights, or in the relevant international legal instruments accepted by the States concerned,
وإذ تضع في اعتبارها أن مهمة الفريق العامل المعني باﻹحتجاز التعسفي ، وفقا للقرار ١٩٩١/٢٤، هي التحقيق في حالات الاحتجاز المفروض تعسفا أو بطريقة أخرى تتنافى مع المعايير الدولية ذات الصلة والمبيّنة في اﻹعلان العالمي لحقوق اﻹنسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية،

وإذ تضع في اعتبارها أن مهمة الفريق العامل المعني باﻹحتجاز التعسفي ، وفقا للقرار ١٩٩١/٢٤، هي التحقيق في حالات الاحتجاز المفروض تعسفا أو بطريقة أخرى تتنافى مع المعايير الدولية المبينة في اﻹعلان العالمي لحقوق اﻹنسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية،

(a) Investigating cases of detention imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned;
)أ( التحقيق في حالات الاحتجاز المفروض تعسفا أو بطريقة أخرى تتنافى مع المعايير الدولية المبينة في الاعلان العالمي لحقوق الانسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية؛

III. When the complete or partial non—observance of the relevant international standards set forth in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned relating to the right to a fair trial is of such gravity as to confer on the deprivation of liberty, of whatever kind, an arbitrary character (Category III).
ثالثاً- عندما يصل عدم الامتثال الجزئي أو الكلي للمعايير الدولية ذات الصلة، المحددة في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية والمتعلقة بالحق في محاكمة عادلة، إلى درجة من الخطورة تضفي على الحرمان من الحرية، أيّا كان نوعه، طابعا تعسفياً )الفئة الثالثة(.

(c) When the total or partial non—observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III).
)ج( إذا كان عدم الاحترام التام أو الجزئي للقواعد الدولية المتصلة بالحق في محاكمة عادلة، المنصوص عليه في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يضفي على الحرمان من الحرية طابعاً تعسفياً )الفئة الثالثة(.

ثالثا- إذا كان عدم الاحترام التام أو الجزئي للقواعد الدولية المتصلة بالحق في محاكمة عادلة، المنصوص عليها في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يضفي على الحرمان من الحرية، أيا كان شكله، طابعا تعسفيا )الفئة الثالثة(.

III. ثالثاً- إذا كان عدم الاحترام التام أو الجزئي للمعايير الدولية المتصلة بالحق في محاكمة عادلة، المنصوص عليها في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يضفي على الحرمان من الحرية، أيا كان شكله، طابعاً تعسفياً )الفئة الثالثة(.

In 1991, the Commission on Human Rights established the Working Group on Arbitrary Detention to investigate detention imposed arbitrarily and inconsistently with international standards in the Universal Declaration of Human Rights and legal instruments accepted by the States concerned (E/CN.4/RES/1991/42).
وفي عام 1991، أنشأت لجنة حقوق الإنسان الفريق العامل المعني بالاحتجاز التعسفي لكي يحقق في حالات الاحتجاز المفروض بشكل تعسفي ومخالف للمعايير الدولية المنصوص عليها في الإعلان العالمي لحقوق الإنسان والصكوك الدولية ذات الصلة التي قبلتها الدول المعنية (E/CN.4/RES/1991/42).

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

(ج) إذا كان عدم التقيّد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

Its outcomes should not supplant those recommendations of specific mandate holders which were either not included in recommendations accepted by the State, or not considered by the Working Group or the plenary.
وينبغي ألا تحل النتائج التي يسفر عنها محل توصيات المكلفين بولايات التي لم تُدرج بين التوصيات التي قبلتها الدول أو لم يتم النظر فيها داخل الفريق العامل أو في الجلسة العامة.

Likewise, the obligations of States entered into under regional human rights systems are complementary to the universal human rights framework.
وبالمثل، تعتبر الالتزامات التي قبلتها الدول بموجب الأنظمة الإقليمية لحقوق الإنسان مكملة للإطار العالمي لحقوق الإنسان.
