47. In view of the divergent practice of national courts and legislation on measures of constraint against State property, the Commission had submitted several alternatives, including a distinction between pre-judgement and post-judgement measures of constraint.

39. With regard to measures of constraint against State property, his delegation agreed with the distinction made by the Working Group and hoped that its debates would elicit new elements that would lead to the selection of one of the three alternatives presented (A/54/10, annex, para. 129).

He recalled the importance attributed by his Government to the three conditions laid down in draft article 18, paragraph 1 (c), for the exercise of measures of constraint against a State and felt that those conditions, taken together, would ensure the balance between respect for the rights of the contracting parties and the free exercise of governmental authority.
وأشار المتحدث إلى ما توليـه حكومته من أهمية للشروط الثلاثة المنصوص عليها في مشروع الفقرة ١ )ج( من المادة ١٨، بغية ممارسة التدابير الجبرية ضد إحدى الدول وهو يرى أن هذه الشروط، إذا ما أخذت معا، من شأنها ضمان التوازن بين احترام حقوق اﻷطراف المتعاقدين والممارسة الحرة للسلطة الحكومية.

37. With regard to the fifth outstanding issue, relating to measures of constraint against State property, several delegations had supported the distinction (paragraph 126 of the report of the Commission's Working Group) between pre-judgement and post-judgement measures of constraint.
37 - أما عن المسألة الخامسة المعلّقة، وهي الإجراءات الجبرية ضد ممتلكات الدولة، فقد أعربت عدة وفود عن تأييدها للتمييز (الفقرة 126 من تقرير الفريق العامل) بين الإجراءات الجبرية السابقة لصدور الحكم وتلك اللاحقة لصدوره.

It also adopted the suggestions of the Working Group contained in its report and dealing with the following five areas: (1) Concept of State for purpose of immunity; (2) Criteria for determining the commercial character of a contract or transaction; (3) Concept of a State enterprise or other entity in relation to commercial transactions; (4) Contracts of employment; and (5) Measures of constraint against State property (chap. VII).
