The representative of Pakistan requested that the report of the Ad Hoc Committee on its eleventh session reflect that her country had joined the consensus on article 6, paragraph 1, of the Protocol, but understood that the offences established in accordance with that paragraph implied the involvement of an organized criminal group.
110- وطلبت ممثلة باكستان أن يجسد تقرير اللجنة المخصصة عن أعمال دورتها الحادية عشرة أن بلدها قد انضم الى توافق الآراء بشأن الفقرة 1 من المادة 6 من البروتوكول، ولكن بناء على الفهم الذي مفاده أن الجرائم المقررة وفقا لتلك الفقرة تعني تورط جماعة اجرامية منظمة فيها.

(a) the offences established in accordance with articles 5, 6, 8 and 23 of this Convention; and
(أ) الجرائم المقررة بمقتضى المواد 5 و6 و8 و23 من هذه الاتفاقية؛ و

1. Each State Party shall adopt such measures as may be necessary to establish its jurisdiction over the offences established in accordance with articles 5, 6, 8 and 23 of this Convention when:
1- يتعين على كل دولة طرف أن تعتمد ما قد يلزم من تدابير لتأكيد سريان ولايتها القضائية على الجرائم المقررة بمقتضى المواد 5 و6 و8 و23 من هذه الاتفاقية في الحالات التالية:

This Protocol shall apply, except as otherwise stated herein, to the prevention, investigation and prosecution of the offences established in accordance with article 5 of this Protocol, where those offences are transnational in nature and involve an organized criminal group, as well as to the protection of victims of such offences.
ينطبق هذا البروتوكول، باستثناء ما ينص عليه خلافا لذلك، على منع الجرائم المقررة وفقا للمادة 5 من هذا البروتوكول، والتحري عنها وملاحقة مرتكبيها، حيثما تكون تلك الجرائم ذات طابع عبر وطني وتضلع فيها جماعة اجرامية منظمة، وكذلك على حماية ضحايا تلك الجرائم.

6. Nothing contained in this Convention shall affect the principle that the description of the offences established in accordance with this Convention and of the applicable legal defences or other legal principles controlling the lawfulness of conduct is reserved to the domestic law of a State Party and that such offences shall be prosecuted and punished in accordance with that law.
6- ليس في هذه الاتفاقية ما يمس بالمبدأ القائل بأن توصيف الجرائم المقررة وفقا لهذه الاتفاقية وتوصيف الدفوع القانونية المنطبقة أو المبادىء القانونية الأخرى التي تحكم مشروعية السلوك محفوظ حصرا لقانون الدولة الطرف الداخلي، وبوجوب ملاحقة ومعاقبة تلك الجرائم وفقا لذلك القانون.

)د( كشف ورصد حركة العائدات والممتلكات المتأتية من الجرائم المقررة في هذه الاتفاقية ، واﻷدوات المستخدمة في ارتكاب تلك الجرائم ، واﻷساليب المستخدمة في نقل أو اخفاء أو تمويه تلك العائدات والممتلكات واﻷدوات ، وسائر اﻷساليب المستخدمة في مكافحة جرائم غسل اﻷموال وغيرها من الجرائم المالية ؛

2. Each State Party shall adopt legislative or other appropriate measures to prevent, to the extent possible, means of transport operated by commercial carriers from being used in the commission of offences established in accordance with article 5 of this Protocol.
2- يتعين على كل دولة طرف أن تعتمد تدابير تشريعية أو تدابير أخرى مناسبة لكي تمنع، الى أقصى مدى ممكن، استخدام وسائل النقل التي يشغّلها الناقلون التجاريون في ارتكاب الجرائم المقررة وفقا للمادة 5 من هذا البروتوكول.

(c) Organizing or directing other persons to commit an offence established in accordance with paragraph 1 of this article.
(ج) تنظيم أو توجيه أشخاص آخرين لارتكاب جرم من الجرائم المقررة وفقا للفقرة 1 من هذه المادة.
