The Council shall by unanimous decision determine the measures necessary to repulse the aggression. In the event that this should prove impossible, the decision shall be adopted by a two-thirds vote of members present and voting. If the aggressor is a Member State, its vote shall not be counted in determining the majority.

82. The President stated that the election would be held in accordance with Annex II to the Convention and outlined the procedure for voting, according to which two thirds of the States parties would constitute a quorum for election and the members elected to the Commission would be those candidates who obtain a two-thirds majority of the votes of the States parties present and voting.

(d) The decision shall be deemed to have been adopted by a simple majority of Member States present and voting, in other cases to which subparagraph (c) of this article is not applicable, having regard to the provisions of article V, paragraph 4 and those of article XVI of the Pact.

A draft amendment was introduced (SPLOS/CRP.20) according to which decisions on budgetary and financial matters should be taken by a three-fourths majority of States Parties present and voting, provided that such majority included States Parties contributing at least three fourths of the expenses of the Tribunal as well as majority of the States Parties participating in the Meeting.
