In accordance with the provisions of Presidential Decrees Nos. 499/1987 and 545/1983, nationals of the European Union member States are entitled to free movement and residence in Greece, in order to carry out a paid or non-paid activity under the same conditions as Greek workers.

(a) The right to freedom of movement and residence within the border of the State, article 36 of the Basic Law stipulates that: " The State shall ensure the security of its citizens and all persons residing in its territory and no one shall be arrested, detained or restricted in his freedom of action except as provided by law. "

While it is stipulated in the preamble (point 3) that " Union citizenship should be the fundamental status of nationals of the Member States when they exercise their right of free movement and residence " , the operative part defines a European Union citizen as " any person having the nationality of a Member State " (article 2 (1)), nationality thus being a prerequisite for European Union citizenship.
وفي حين ورد نص في الديباجة (النقطة 3) بما مؤداه أن " تكون مواطنة الاتحاد الأوروبي وضعا أساسيا لرعايا الدول الأعضاء عندما يمارسون حقهم في حرية الحركة والإقامة " ، يعّرف جزء المنطوق مواطن الاتحاد الأوروبي بأنه " شخص يحمل جنسية دولة عضو " (المادة 2 (1))، أي أن الجنسية تصبح شرطا أساسيا لمواطنة الاتحاد الأوروبي.

On the merits of the communication, the Committee held that while the wording of the resolutions referred explicitly to Romas previously domiciled in the concerned municipalities, the context of their adoption indicated that other Romas would have been equally prohibited from settling there, and thus found a violation of article 5, paragraphs (d) and (i) of CERD (right to freedom of movement and residence).
