35. The Working Group considers detention to be arbitrary if there has been a total or impartial inobservance of applicable international human rights norms on fair trial of such seriousness as to give the deprivation of liberty an arbitrary character.
35- ويعتبر الفريق العامل الحرمان من الحرية تعسفياً في حالة حدوث خرق كامل أو جزئي للمعايير الدولية الواجبة التطبيق في مجال حقوق الإنسان فيما يتعلق بالمحاكمة العادلة يكون من الخطورة بحيث يضفي على الحرمان من الحرية طابعاً تعسفياً.

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

The Working Group reserves the right to render an opinion, on a case-by-case basis, whether or not the deprivation of liberty was arbitrary, notwithstanding the release of the person concerned;
ويحتفظ الفريق العامل بالحق في أن يدلي برأي في كل حالة على حدة، يبين فيه ما إذا كان الحرمان من الحرية تعسفياً أم لا، على الرغم من الإفراج عن الشخص المعني؛

3. The Working Group regards deprivation of liberty as arbitrary in the following cases:
٣- ويعتبر الفريق العامل الحرمان من الحرية تعسفياً في الحالات التالية:

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial, as established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد ًكليا أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial established in the Universal Declaration of Human Rights and in the relevant international instruments that have been accepted by the States concerned is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

(ج) إذا كان عدم التقيّد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

In accordance with paragraph 23 of its methods of work, after having transmitted an urgent appeal to the Government, the Working Group may transmit the case through its regular procedure in order to render an opinion on whether the deprivation of liberty was arbitrary or not.
10- ووفقاً للفقرة 23 من أساليب عمل الفريق العامل، وبعد إحالة نداء عاجل إلى الحكومة، يجوز للفريق العامل أن يحيل القضية عن طريق إجرائه العادي من أجل إبداء رأي يبين ما إذا كان سلب الحرية تعسفياً.

23. After having transmitted an urgent appeal to the Government, the Working Group may transmit the case through its regular procedure in order to render an Opinion on whether the deprivation of liberty was arbitrary or not.
23- وبعد إحالة نداء عاجل إلى الحكومة، يجوز للفريق العامل إحالة القضية عن طريق إجراءاته المعهودة من أجل إبداء رأي يبين ما إذا كان الحرمان من الحرية تعسفياً.

3. The Working Group regards deprivation of liberty as arbitrary in the following cases:
3- ويعتبر الفريق العامل الحرمان من الحرية تعسفياً في الحالات التالية:

He refers to the criteria under which the Working Group on Arbitrary Detention determines whether a deprivation of liberty is arbitrary.

(e) An account of the reasons why the deprivation of liberty is deemed arbitrary.

(f) This constitutes a series of violations serious enough to make his deprivation of liberty arbitrary, in violation of articles 9, 10 and 11 of the Universal Declaration of Human Rights;
