In that regard, article 8 of the 1948 Universal Declaration of Human Rights provides that: " Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law. "
وتنص المادة 8 من الإعلان العالمي لحقوق الإنسان لعام 1948 في هذا الصدد على ما يلي: " لكل شخص حق اللجوء إلى المحاكم الوطنية المختصة لإنصافه الفعلي من أي أعمال تنتهك الحقوق الأساسية التي يمنحها إياه الدستور أو القانون``.

56 - على مستوى أعم، تنص المادة 8 من الإعلان العالمي لحقوق الإنسان الصادر في كانون الأول/ديسمبر 1948 على أن " لكل شخص حق اللجوء إلى المحاكم الوطنية المختصة لإنصافه الفعلي من أية أعمال تنتهك الحقوق الأساسية التي يمنحها إياه الدستور أو القانون " .

The right to challenge the lawfulness of detention before court and to a remedy follow from the combined reading of articles 8 and 9 of the Universal Declaration of Human Rights, whereby " everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law " and " no one shall be subjected to arbitrary arrest, detention or exile " .
10- ويتضح حق الطعن في شرعية الاحتجاز أمام المحكمة والحق في الانتصاف من خلال قراءة المادة 8 مقترنة بالمادة 9 من الإعلان العالمي لحقوق الإنسان، اللتين تنصان على أنه " لكل شخص حق اللجوء إلى المحاكم الوطنية المختصة لإنصافه الفعلي من أي أعمال تنتهك الحقوق الأساسية التي يمنحها إياه الدستور أو القانون " وأنه " لا يجوز اعتقال أي إنسان أو حجزه أو نفيه تعسفاً " .
