Article 2, paragraph 2, of the Covenant requires States parties to take such legislative or other measures which may be necessary to give effect to the rights recognized in the Covenant.

14. It also seems to us essential to safeguard the unity of the Covenant through all the rights recognized in it.

15. The International Covenant on Civil and Political Rights, to which the Republic of Moldova is a party, provides in its article 2 that each State party to the Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the Covenant.
15- وجاء في المادة 2 من العهد الدولي الخاص بالحقوق المدنية والسياسية، الذي انضمت إليه جمهورية مولدوفا، أن كل دولة طرف في العهد تتعهد باحترام الحقوق المعترف بها فيه وبتأمين هذه الحقوق لجميع الأفراد الموجودين في إقليمها والخاضعين لولايتها.

3. Secondly, the positive obligation undertaken by States parties under that article may itself have an inevitable impact on legislation or administrative measures specifically designed to regulate matters other than those dealt with in the Covenant but which may adversely affect rights recognized in the Covenant.
3- ثانياً، إن الالتزام الإيجابي الذي تعهدت به الدول الأطراف بمقتضى تلك المادة قد يكون لـه هو نفسه أثر أكيد على التدابير التشريعية أو الإدارية التي وضعت خصيصا لتنظيم أمور غير تلك التي يتناولها العهد والتي يمكن أن تؤثر مع ذلك تأثيراً ضاراً على الحقوق المعترف بها فيه.

The Declaration explicitly states in article 22 that in its implementation, States shall take measures, jointly with indigenous peoples, to ensure that women enjoy full protection and guarantees against all forms of discrimination; and, in article 44, that all of the rights recognized in the Declaration are equally guaranteed to male and female indigenous individuals.

In article 2, paragraph 1, of the International Covenant on Civil and Political Rights, on the other hand, each State party to that covenant undertakes " to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant ... " (emphasis added).

The Committee on Economic, Social and Cultural Rights notes, for example, in its general comment No. 3 (1990) on the nature of States parties' obligations, that the rights recognized in the Covenant entail immediate obligations not subject to the availability of resources or to progressive realization.

For example, there is an inconsistency in article 2 of the International Covenants: the International Covenant on Economic, Social and Cultural Rights guarantees that " the rights enunciated in the present Covenant will be exercised without discrimination of any kind " , whereas the International Covenant on Civil and Political Rights guarantees " the rights recognized in the present Covenant, without distinction of any kind " .

72. The International Covenant on Economic, Social and Cultural Rights establishes, in its article 2, that the rights recognized therein apply to individuals without discrimination on the basis of, inter alia, sex.

Consequently, it was difficult to see how the words of article 2 of the Covenant regarding a State party's undertaking to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized therein were only capable of interpretation as meaning that they applied solely to people who were both within the territory and subject to its jurisdiction.

10. States parties are required by article 2, paragraph 1, to respect and to ensure the Covenant rights to all persons who may be within their territory and to all persons subject to their jurisdiction.
