فالإعلان العالمي لحقوق الإنسان ينص في مادته الثامنة على أن لكل شخص الحق في أن يلجأ إلى المحاكم الوطنية المختصة لإنصافه عن أعمال فيها اعتداء على الحقوق الأساسية التي يكفلها له الدستور أو القانون().
